Texas restaurant chain ordered to pay $2.8M to woman burned by BBQ sauce [Jackpot alert]

A Texas jury has ordered a restaurant chain to pay $2.8 million to a woman who filed a lawsuit after she was burned by BBQ sauce.

Genesis Monita, 19, sued Bill Miller Bar-B-Q Enterprises in October 2023 after she had been served sauce that gave her a second-degree burn earlier in the year.

The incident took place in May 2023 when Monita ordered breakfast tacos with barbecue sauce from the restaurant, according to court documents seen by FOX 26 Houston.

After taking the sauce out of the bag, Monita dropped it on her leg because of how hot the container was and sustained a second-degree burn.

The restaurant's policy states that sauce is a minimum of 165 degrees when it's served, according to the lawsuit, and the sauce was reportedly 189 degrees that day.

Monita was awarded $2.8 million total by a jury of six men and six women on Friday.

More than $25,000 was paid to her for medical expenses following her injury and $900,000 was for past and future mental anguish, physical pain and impairment.

The restaurant franchise was found to be "grossly negligent" by the jury, awarding Monita $1.9 million in punitive damages.

It’s served at 165 but should only be served to people whose IQ is over 60.

It’s getting to the point at which restaurants will need to have people sign a release before eating there:

- Our ingredients are listed. We are not responsible for food allergies/reactions.
- Our coffee and hot foods are cooked such that they will be at edible temperatures when served. However, times from preparation to service to the customer can vary. Customers should always use caution to prevent burns.
- Aspiration of any food can occur unexpectedly and cause choking. Always use care and discretion when consuming food.

Welding metal you can get very localized 3 degree burn outside picking up a large hot piece.

“5 seconds at 140 deg contact with the skin can cause 3rd deg burns.”

3rd degree burns involve charring of the skin and a smell like BBQ. Unless the liquid is a 400F metal one has to continue to heat the substance (or it be ectothermic) for anything but a superficial burn.

She looks porky enough to need ,lots of BBQ sauce - I bet she would’ve sued if it was too cold too - too bad she was in such a hurry to open a container that she found too hot to comfortable hold onto...

Some juries are like the getaway driver for bank robberies. Only they are helping to rob businesses and individuals

That's how I see them. They shouldn't be immuned from the consequences of their attempts to steal other people's money.

That isn’t a measure of hot barbecue sauce. How far into steel plate one drop can go is a proper measure, sort of like alien spit.

Not necessarily.
Had a passed out friend who’s leg
was severerly burned (required skin
grafts to repair), after exposure
to a heater vent all night.
Badly burned, but not blackened,
and it didn’t smell.
3rd deg burns are damage done to a
depth of muscle tissue.

How did they know the exact temperature of the sauce?

Because things like that are kept in a warmer with a readout that tells you how hot the sauce is. Now days they have memory on the device that keeps a record and probably sends it to someone's phone.
