A Military Court is a federal court so the traitor may be in the clear

If I remember my Civics classes from decades ago, “treason” is the only crime listed in the Constitution that can not be pardoned.

Having said that, treason has a high standard to prove.

No, treason can be pardoned. Only impeachment can’t be pardoned. See https://www.usconstitution.net/presidential-pardon-limits/

China arguably committed an act of bio warfare against America with Covid -19 .

This is an explicit act of war by China against the US

If you recall, China was reportedly prepping for potential nuclear attack by the US so the Chinese were obviously concerned that the Covid-19 outbreak could be seen as a bio warfare attack against the US.

US policy is that the appropriate response to a bio weapons attack can be a nuclear response.

Milley is on record as saying that he was collaborating with the Chinese military to thwart any possible nuclear attacks on China by the US.

Thinking a pretty plausible case could be made that Milley’s actions meets the standard for treason in that context.

You are kind of right, but not really.

In Article II the President "shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

Treason, Bribery, and High Crimes and Misdemeanors are offenses for which a President can be impeached. So, if a President, say Biden, were IMPEACHED for treason, his successor could not pardon him for that.

But if citizen Biden were indicted and convicted for treason in an Article III court, he could be pardoned just like any other citizen.

It seems like he was pretty much bragging about consorting with the enemy regarding nuclear weapons and more. I think we need to go through the process to find out, even if it does take a long, long time.

Lets see, how many of the J6 people are still imprisoned awaiting trial? Pardons carry an admission of guilt and therefore a specific crime is suggested. Charge him with something else.
