In New York, adultery is no longer illegal. On Friday, Governor Kathy Hochul approved the repeal of 1907 legislation that forbade the conduct.
The penal law of New York had previously stated that “a person is guilty of adultery when he/she engages in sexual intercourse with another person at a time when he/she has a living spouse, or the other person has a living spouse.”
The law was considered a Class B misdemeanor if broken, which carries a sentence of up to three months. The New York State Senate referred to the law as “outdated,” labeling it Biblically based.
“While I’ve been fortunate to share a loving married life with my husband for 40 years—making it somewhat ironic for me to sign a bill decriminalizing adultery—I know that people often have complex relationships,” Hochul said. “These matters should clearly be handled by these individuals and not our criminal justice system. Let’s take this silly, outdated statute off the books, once and for all.” …

All of the other laws that involve morality (murder, dishonesty, theft, etc.) are Biblically-based, too.

If she was my woman, I think I’d be cheating on her already.
In related news, Hochul will be passing a new law requiring all New York women to pay a $25 tax for each sex act they perform on their husband and boyfriends from now on. No tax on tips though.

Yes and no.
I would agree that common sentiment about adultery in North America comes from biblically based religious sentiment - that adultery is a sin.
However, that does not mean that when considered rationally, that for the benefit of society adultery, and its social disruption, flows against the building of successful family units, and a higher ratio of successful family units to unsuccessful ones has proven, in every society, to produce greater social stablity and greater economic safety for the family units as well as greater economic stability and success for society.
Therefor, even minus any religious text, there is sound reason for society to frown on adultery, and make it a crime as well. Shunning has a role in behaviour and increasing the behaviors opposite of that which is shunned. When dealing with improving society, that is a good.

What about before 1907? Why did they pass the law at that particular time? It’s not like people didn’t think adultery was wrong in the 19th century.
Something’s up....So who is/was suing using adultery for the grounds. It’s been used as grounds for divorce a bazillion times.
We can’t afford the cost of incarceration.
