Former President Trump on Monday received one of his biggest wins yet in fighting his criminal charges when a judge tossed his classified documents indictment.
By ruling that special counsel Jack Smith was unlawfully appointed, U.S. District Judge Aileen Cannon’s decision sets aside Trump’s 40 criminal charges that accuse him of mishandling classified documents and obstructing the government’s efforts to retrieve them from Mar-a-Lago.
Here are five takeaways from Trump’s major win:
First of Trump’s indictments dismissed
Decision latches onto Thomas’s concurrence
Jack Smith plans to appeal
Ruling comes at start of GOP convention
Ruling divides Democrats, GOP

Jack Smith Perpetrated a Felony FRAUD upon the Court, Armed Robbery, Breaking and Entering, Extortion, He should be held Criminally Liable for all the CRIMES he COmmitted while PRETENDING to be an “Officer of the United States”.
The DoJ under Garland might refile.
Is that not possible?
Shouldn’t Florida be empaneling a Grand Jury to INDICT Jack Smith for all the CRIMES he committed in FLORIDA while Impersonating an Officer of the United States???
“Fraud”
Just as on January 6th, no obviously participating party was hiding anything.
By that they mean one like Juan Merchan
If Jack Smith is not authorized to represent the government, how can he appeal?
> The DoJ under Garland might refile. Is that not possible?
Maybe not (”lack of standing” TM).
This will goto the Supreme Court where Jack Smith will lose. The current court is very focused on returning the Constitution to preeminence and this special counsel scam is a clear case of the Biden Regime ignoring constitutional limits on the executive branch.
No standing!-)
Happens all the time;-)
1st appeal to 11th Circuit. Justice Thomas’ Circuit
>> If I’m Jack Smith and the DOJ, I might consider handing the Mar-A-Lago case to the United States Attorney for the Southern District of Florida, re-indict, and hope it gets assigned to a more competent judge than Cannon
Because Jack Smith was not a legitimate prosecutor, any evidence he gathered would be fruit from a poisoned tree...???
What the heck does this idiot have to appeal about? He was never confirmed, so he has no legal office... The guy’s a moron who shouldn’t be practicing law... The end.
With evidence illegally obtained?
Should be interesting.
In all due fairness to Judge Cannon, she brought up the subject of the appointment long before Thomas did, not that either of them deserve less credit.
P.S. The violation of civil rights lawsuit ought to be in the billions of dollars.
Or Engeron. Not gonna happen though.
There is no more competent judge than Cannon.
How long would that process be? No way anything is before Trump’s inauguration.
First the appeal, even if Jack wins then the issue of what evidence is subject to privilege must be decided in another court process before anything could move forward.
Alternately to refile the case they need a Grand Jury empaneled. There needs to be a privilege determination. The Mar-A-Lago case is gutted by the SC privilege decision. They also contaminated the evidence so the raid evidence is essentially useless.
