Joe Biden appears to be in a free fall in the polls, yet he appears unwilling to drop out of the presidential race. His campaign, the White House, and the Democratic Party are all in chaos. If Biden won't leave, what is the party to do? If "Plan B" is replacing Biden and he won't go, a left-wing scholar is advocating a "Plan C" to save the president's floundering campaign.
Supporters of this plan suggest a straightforward strategy to counter Trump’s growing campaign momentum: replace Vice President Kamala Harris with former President Barack Obama.
“A Biden-Obama ticket would have a much better chance of beating Trump,” explained John Banzhaf, a professor at George Washington University Law School.
“Barack Obama is likely one of the few individuals whom a majority of Americans would want and trust as president," he claimed, without evidence. "Making Plan C possibly the least objectionable of several unappealing options now available to Biden and the Democratic Party."
Banzhaf argues that none of the alternatives to Biden appear to be in any better position to win the presidency, and even if they were, the money raised by the Biden-Harris campaign can't simply be transferred to another campaign.
You're probably thinking, "But what about the 22nd Amendment?"
Banzhaf argues that the 22nd Amendment, often cited as a barrier to Barack Obama serving as president again, doesn't actually prevent him from becoming vice president and then succeeding to the presidency.
The 22nd Amendment:
"No person shall be elected to the office of the president more than twice, and no person who has held the office of the president, or acted as president, for more than two years of a term to which some other person was elected president shall be elected to the office of the president more than once."

Technically, nothing in the Constitution prevents anyone from serving more than two terms. The 22nd Amendment prevents someone from being elected to more than 2 terms. That is the rub here. Now logic would seem to dictate that if you can't be elected as president you can't be elected as vice president, but there is nothing specifically in the Constitution about that. The 12th Amendment says if you are not constitutionally eligible to be president, you cannot be vice-president. The Constitution only has 3 eligibility requirements for president - over 35, natural born citizen, a resident of the US for the past 14 years.
The argument they will raise is that Obama obviously meets the constitutional eligibility requirements since he has already served as president before. They will argue that he could not be elected president, but if elected VP he could serve as president because he was not elected as president more than twice.
Keep in mind that we have already have had at least one president that was not elected as either president or vice-president. Gerald Ford was a congressman from Michigan when Spiro Agnew resigned. He was appointed as VP by Nixon and approved by Congress. Then Nixon resigned and Ford became president. So you could even see a scenario where Biden and some other person as VP (Harris would never go along with this) were elected. After being sworn in, the VP could resign and Biden could appoint Obama as VP. If the Dems had a majority in both houses of Congress, they could approve the appointment. Then Biden could resign and Obama would become president.
If SCOTUS decided this was a political question and refused to decide it, what could anyone do to stop it? And I can think of at least 4 votes on SCOTUS that would be happy to punt on an issue like this - the three libs and Roberts, Roberts because he wouldn't want SCOTUS to be seen as deciding the election. All they would need would be one more - Kavanaugh or ACB would both be good candidates. Remember, SCOTUS refused to get involved in any of the election cases in 2020.

Even black voters in record shattering numbers are saying Barack Hussein Obama did nothing for them, Trump did so much more. Run Barack Run it will be great to see you overwhelmingly rejected.

Yes, this “professor” neatly avoids the rather obvious— very early Amendment to deal with JUST THIS kind of thing. He cannot serve as VP because he has already served as President, two terms. Cannot do this.
This isn’t an original professor idea— Larry Tribe the looney seems to think it’s ok. Dershowitz should start setting these clowns straight— if he’s honest enough.
He served two terms. He is ineligible.
1) Unconstitutional, won’t work.
2) HOUSE must approve any new veep nomination. Johnson would block.
3) Zero is too lazy to run again.

Which was wraught with the elimination of any more that two terms as President no matter when they are elected. That happened after FDR’s three sequential terms, during 3 term he fortunately died.

Stretching the what ifs quite a bit here. This assumes that any more “obama” inside an already crap filled Biden— is making sure people really know who has been screwing up our country ALL ALONG! It’s been obama, and Trump has pointed this out to all— even the bernie bots get this, and will not be backing biden or harris— or, obama the ghost rider.
Being President prior- for two terms IS an ineligible Constitutional definition— for either being a VP in the first place and President in the second. It’s not rocket science.
This is NOT something SCOTUS would need to address- it’s rather simple actually. And powers that be will not stand for this kind of S.American junta crapola.
