SCOTUS must act to remain relevant
7thof7th

Posted on 05/31/2024 2:44:55 PM PDT by 7thOF7th

If the SCOTUS does not intercede in this abomination of a judicial process, why do the American people even need a SCOTUS? What role do they play in a post-America where justice is served at the whim of political activism? It seems to me that to preserve their relevance, SCOTUS must be heard!

We don't know what Merchan will do on July 11. If he doesn't restrict Trump's movements, he can go to Milwaukee. Of course that is not a given.

Maybe he will restrict Trump to Trump Tower and tell him he can participate in the convention by Zoom.

Not to mention the jury going home for a week before final arguments. Talk about ripe!

Now, maybe, if the judge throws him in jail, house arrest, or more

Which is why the judge will NOT jail Trump. They want to keep this in NY for at least 157 days. They might frog-march him into his sentencing for photos, but they won't jail him. Whatever sentence he receives in July, and it probably won't be prison, will be stayed pending appeal. The NY Appeals Court might even overturn the conviction themselves after Nov 5th.

All it takes is a re-listen to US Senator Schmucky Schumers threats made to them, and for which there were ZERO legal consequences

the reports are of such a sham trial, on such bogus and stale charges, with such appallingly improper jury instructions, as to call the entire judicial system into question
(which is a tactful way of saying that it is such unjust kangaroo courts like this that lead millions of Americans to disrespect the law. No, to have utter contempt for the law. it is corrupt and does not afford equal protection or due process to American citizens

The US Supreme Court won’t take this up now, it is not ripe for them. It will need to go through the steps. Now, maybe, if the judge throws him in jail, house arrest, or more, it will rise to them but I think they’ll wait.

The Biden Administration is at the point now where they can simply ignore the SCOTUS. Why not?

They became irrelevant when they ruled the states had no standing to challenge the 2020 fraud of an election. Cowards.

Yippie the process is so fair you now get to spend more millions fighting appeals and a few years from now it could be overturned!

The Supreme Court is still smarting from the criticism it received after it stopped the recounts in Florida in December 2000

I don't think so. Only one member of that Court is still sitting on the bench today, Justice Clarence Thomas.

Hell, remember when SCOTUS told Biden that he lacks the constitutional authority to forgive student loans?

How did that work out?

Who thinks the Dems are scared to rig the Election in the states?

Speak up. There is never any accountability for Dems.

It’s part of the same problem.

SCOTUS didn't know what the outcome of the selective recount in Florida would be either, but they stopped it as the predicate crime was the rogue decision by the Florida SCOTUS in the first place.

The same is true in New York. Why let Merchan further injure Trump with a sentencing hearing in July when we already know that the trial that produced that conviction was based on many violations of Trump's constitutional rights?

The constitutional violation has already occurred in the trial; the conviction is tainted. Waiting until the sentencing hearing would only double the harm.

Different scenarios.

If SCOTUS throws out the Trump conviction in "The People of the State of New York v. Donald J. Trump (IND-71543-23)," are you suggesting that New York will simply issue an arrest warrant for Trump in violation of his conviction or something in defiance of SCOTUS?

At this point, nothing would surprise me.

A 6-3 ruling in favor of Trump? They'll just argue that three of the justices are illegitimate because Trump, a now convicted felon, put them on the bench and that Alito flew a Trump flag or something so he's out and the ruling is actually 2-3. "Conviction stands!"

You know, because we've got to save democracy or something.

the real intent of attacking trump is also to thwart the will of the people who elected him, and the supreme court he empaneled to support their will long term... who thwart uncle joe time and again... they want to drag the supremes into this so they can use it to drive their ballot counting cover.
1. Defeating Trump is the titular goal.
2. Discrediting the Supremes is a the republic Killing coupe d’état.
3. Disempowering the republic’s majority Judeo-Christian zeitgeist would complete their coveted “hat trick...”

The thing that most of us need to understand is that the Supreme Court rarely acts with haste. It takes its time. SCOTUS is not concerned with the fate of Donald Trump, per se. I think they could be motivated to step in, if they believe that some bedrock legal principle is being violated. There’s a lot of optimism that either the NY Supreme Court or Appeals Court could send this case back to the trial court based on multiple violations of law and judicial procedure by the trial judge. But if the appeal goes up from there, it’s not clear that SCOTUS would act unless it represents a clear case for them to protect a bedrock legal principle. That’s my two cents, anyway.

I believe they would have to file a writ to Sotamayor sine she leads the court district. I don’t think she’s going to grant it now.
