In a lawsuit filed Tuesday against the U.S. government, TikTok and ByteDance argued the law, the Protecting Americans From Foreign Adversaries Act, violates the First Amendment.
The law gives ByteDance 270 days to sell TikTok to a new company that will be allowed to operate it in the U.S., or the app will be banned from American networks and online application stores. The president can give ByteDance an additional 90 days to sell TikTok if he determines it necessary.
But TikTok argued “qualified divestiture” is “simply not possible: not commercially, not technologically, not legally,” and it therefore would lead to a shutdown of the app in the U.S., cutting off millions of daily users.
TikTok also called out the law for singling out the app by name. While the law grants the president authority to name other applications that could fall under the same regulations, but TikTok and ByteDance are the only ones specified in the measure.
Even if the sale was “feasible,” TikTok argued, the law still would be “an extraordinary and unconstitutional assertion of power” and set a precedent that allows the Congress to “circumvent the First Amendment by invoking national security and ordering the publisher of any individual newspaper or website to sell to avoid being shut down.”

The idea that TikTok presents a threat to our national security is a joke. What useful information are they collecting that China can’t easily acquire elsewhere via US data brokers? It’s about censorship and everyone knows it. The young creators on there are mostly pro-Palestine and that is aggravating the Zionists. All the kids over there know exactly what this is about. Free speech is messy, at times.
It’s bad enough they are going after TikTok. But what really ticks me off is next they put forward the “Antisemitism Awareness Act” which totally abrogates the 1st amendment. I guess the only thing we can deduce from this is that Zionists really really hate free speech. Gee I wonder why?
Without full information, on the surface, I stand with TicToc on this. The government has NO RIGHT to decide who can speak and who cannot. Even though they’ve been doing it for many decades.

Putting all the legal stuff aside for a moment it brings joy to my heart to see congress bitch-slapped by the chicoms regarding the 1st Amendment. Especially Johnson.

Yes it’s a concern but dont expect much sympathy here based on constitutional grounds it passed with overwhelming majorities.
Only the judges stand in the way now. It might go all the way to the Supreme Court.
