An Illinois woman filed a class action lawsuit against Target, accusing the retail giant of collecting and storing her biometric data, including face and fingerprint scans, without her consent in violation of state law.
Arnetta Dean, who filed the lawsuit with the intention of preventing Target from further violating the privacy rights of state residents, is also pursuing statutory damages for the company's alleged collection, storage and use of customers' biometric data, according to the lawsuit obtained by FOX 32 Chicago.
The lawsuit, filed last month in Cook County, claims Target's surveillance systems, including cameras with facial recognition technology installed in Illinois stores, "surreptitiously" collect biometric data on customers without their knowledge or consent.
"Target does not notify customers of this fact prior to store entry, nor does it obtain consent prior to collecting its customers’ Biometric Data," the lawsuit said.

Biometric data is unlike other identifiers used to access sensitive information because it is biologically unique and cannot be easily changed if compromised, putting individuals at increased risk for identity theft, the lawsuit said.
"For example, social security numbers, when compromised, can be changed," according to the lawsuit. "Biometrics, however, are biologically unique to the individual; therefore, once compromised, the individual has no recourse, is at heightened risk for identity theft, and is likely to withdraw from biometric-facilitated transactions."

If they’re trying to tell me a remote scan can take fingerprint data at a crappy place like target I am not buying that

Anybody who goes out in public needs to realize they are CONSTANTLY being recorded whether it’s by their neighbors’ door cams, car dash cams (front and back) and a great variety of government/business CCTVs. And they all have the capability to “collect” and record the captured images. There are other means by which you are being tracked and your travels recorded. Everybody needs to be aware of this.
I’m not sure how they would collect fingerprints (?).
As far as facial recognition goes, I’m not sure this can be stopped, or, should we expect that it be stopped?
The moment you step in public you’re probably being recorded. Expecting a camera to not be hooked into some face scanning software isn’t enforceable. It could be used to identify trespassed persons. Sales teams may want to know what items you looked at, send you recommendations. E.g. you looked at only 70” or higher TV’s the last time you were in the store, now you’re back, a system could prompt an employee to inform you there’s a sale on an 82” TV.
You are in their place of business. They already record you, they don’t need your permission. Your face is not private. Is a system recognizing you any different than a person doing so?
Unless they’re doing something more sinister I don’t see a legal basis for a lawsuit. As said, the fingerprint claim is odd.

Of course they’re not allowed to collect biometric data without consent.
