My Son Finally Confirmed Paternity, and Now We Want Our Money Back

I wasn’t planning on grandchildren for at least another five years, but my son came home at age 22 and informed me that he was going to be a father. I am not a fan of his girlfriend at all; there is just something about her that makes me not trust her. I tried to communicate this to my son, but he is blinded by her beauty, among other things, and has never been able to hear what I have to say about her.

Now that the baby has arrived, my son truly has blinders on. He is so in love with his baby boy that the idea of getting a paternity test seems pointless to him. I told him that he should get it just to remove all doubt that the baby might not be his. They have had plenty of heated arguments while she was pregnant, and she is guilty of spewing comments about the baby not being his. My son assures me that she only has said those things out of anger and that the baby is most certainly his.

I told my son that he needs to be reimbursed for any and all monies he spent on her prenatal care. I personally want the money back for what we spent on throwing her a baby shower and on big-ticket items we bought, like the car seat, crib, and pack-and-play. My son is emotionally scarred and can’t think straight right now, so it is my job to make sure he is asking for the right things. Is it petty to demand money back for what my son and I spent on a child that’s not his?

I recall a lesson from grade school about crossing a rail road tracks.

STOP LOOK AND LISTEN it covers many subjects.

Legally, that may not be correct -- if deliberate fraud could be proven. As a practical matter, it absolutely is. Dad needs to tell his boy "Let her keep the cheese, you just get out of the trap

He didn’t “knock her up”....That’s what this whole thing is about...he’s not the one who got her pregnant...

If his name is already on the birth certificate, it is probably too late (he should be expecting a visit from the sheriff's office serving him papers for child support).
I was I was joking about that, but that is how it seems to work. I know that first hand...

Generally that was after some years and the man had a relationship with the child.

I am assuming (and we all know what that does) that the child is under a year. If so it can be done.

However if he does not do it now he can kiss his money goodbye because the courts say, "you had the evidence for HOW long? And you did nothing? Ok, your inaction means you accepted the child as yours regardless of DNA."

I know people want to be nice and work things out in a civilized manner. But when it comes to legal matters that works against you. When it comes to legal matters it is best to hit quick and hard because the longer you let it drag on the more screwed you are going to be.

For the benefit of anyone reading this in a similar circumstance:

(disclaimer: I am not an attorney, and State laws differ on paternity)

- These grandparents (or not-grandparents) have zero standing. They themselves can’t do a thing but advise.

- The guy in question may or may not have signed an affadavit of parentage(AOP). This document is a Good Thing if someone is in fact Dad as it preserves parental rights and in the event of Mom being a bad actor who wants to split, helps show Dad was involved from the beginning if it comes to custody struggles.

- Conversely, like here, the AOP is your bane if you’re not. Georgia may not have laws to undo paternity but if not or until, if the guy signs, he’s Dad legally and financially. A test is legally just evidence which is nothing without a case.

- Nation-wide, the standard for child support is ‘in the best interest of the child.’ If Guy paid for the birth, and is supporting the child, and is acting like Dad to the child, and then Mom suddenly wants to hang with biological Dad and files for support, there’s a very good chance support will be ordered against Guy. (Don’t ask me to quite explain how a kid is best served by embittering every adult, and financially empowering Mom to teach the kid that people including them are disposable money buckets).

- Besides the obvious advice to get married before children and stay that way, which is too late for this guy, the next advice would be to talk her into talking bio-dad into signing one of those AOPs. That way if the mess gets worse he’s got a good case (literally) for why the process shouldn’t steamroller his life.

The real people involved won’t see this and it probably wouldn’t help anyway. It’s so wierd but people who have a track record of making bad decisions like “I want to have a boyfriend and some dudes on the side” or “I know she’s sleeping around but” tend to not listen to good advice. Usually takes a big flat shovel of reality in the face before change happens ... if at all.

They’re not married, girlfriend is the term the author used.

I would put a lawsuit on record to give other men fair warning. They don’t have to get everything back, just some and consider the rest payment for services rendered.

The baby deserves a better mother; it’s too bad there’s no way to retrieve the innocent from the guilty and give the baby a better chance in life. Unless, of course, his son keeps getting girlfriends and begetting offspring instead of waiting for a wife.

Paternity tests are one reason many married women strongly support abortion. Some married women fool around, and are not sure who the father is, so they like the have the abortion option to avoid later problems.

In this case, like many, it is likely the child’s support will come from the government and will be raised by a single mom with limited emotional stability. Many of these kids, especially boys, would be better off placed in an orphanage.

surely you cant just put anyones name as the father on the birth certificate? I mean what would prevent every woman from claiming Trump is the father of their baby then? Surely the man has to agree to be put on the birth certificate to begin with
