My Son Finally Confirmed Paternity, and Now We Want Our Money Back

I wasn’t planning on grandchildren for at least another five years, but my son came home at age 22 and informed me that he was going to be a father. I am not a fan of his girlfriend at all; there is just something about her that makes me not trust her. I tried to communicate this to my son, but he is blinded by her beauty, among other things, and has never been able to hear what I have to say about her.

Now that the baby has arrived, my son truly has blinders on. He is so in love with his baby boy that the idea of getting a paternity test seems pointless to him. I told him that he should get it just to remove all doubt that the baby might not be his. They have had plenty of heated arguments while she was pregnant, and she is guilty of spewing comments about the baby not being his. My son assures me that she only has said those things out of anger and that the baby is most certainly his.

I told my son that he needs to be reimbursed for any and all monies he spent on her prenatal care. I personally want the money back for what we spent on throwing her a baby shower and on big-ticket items we bought, like the car seat, crib, and pack-and-play. My son is emotionally scarred and can’t think straight right now, so it is my job to make sure he is asking for the right things. Is it petty to demand money back for what my son and I spent on a child that’s not his?

If he has the DNA from the baby, he could try to submit the DNA on ancestry.com or one of those cites that match DNA to find this guys relatives. He would probably need a PI to find this guy, especially if the mother just met him at a bar and had a one night stand with him. I think it has legal merit under “unjust enrichment”.

Free to ask for it back, but someone so manipulative isn’t going to give it back... could take her to small claims court alleging fraud I suppose and see what happens... but honestly even if you win, I doubt this woman would ever pay you a dime, so you would then have to turn the claim into a lien and go through the process of taking her stuff to sell to be made whole, and I would bet she doesn’t have much to begin with. sooo....

Besides, I like them better than the people that have opinions on things based on facts they made up and then try to go on a crusade.

well, if a man goes around and shacks up with a woman who is not his wife, without protection...what does he expect?....

babies are conceived between a male and a female thru s..e..x...

perhaps the young man should have NOT had sex and at least not have sex without using a condem....

no sympathy..

I’d go with the 53, flew in those when I was in the USMC, leaky bitches but heavy haulers. Never liked the 46’s, saw the rotors go out of sync once in Indian Springs, looked like someone twisted a soda can.

OK.

assuming the worst case, that the father signed the certificate based on the (incorrect) assertion that the girlfriend gave him that he was the father, what are his legal recourses?

morally, to me at least, it does not seem to matter that the girlfriend lied if the dude subsequently stated to a credible witness that he did not care if the baby was not his baby and that he would take care of it anyway.

it sounds like this guy just became a cuck for the next 18 years. what would stop his girlfriend from kicking him out of her bedroom for some other chad, and charging him for child support for the next 18 years? at least, to me it sounds as if this is going to be the final part of the story, unless the guy figures out a way to disappear, or offs himself... while the girlfriend— unless she has a heart of gold— gets the best of everything for nothing...

If that happens, some mothers may have some explaining to do, right there after having their baby.

A good friend used to be a delivery nurse in an inner city hospital. The staff would consult with the expectant mother about paternity because there were regularly fights in the delivery room when the kid came out as clearly not sired by the man the mother claimed was the father.

When the hospital had a likely candidate, they'd have security on standby along with the local cops who were in and out of the hospital all the time.

The delivery room fights usually weren't with the mother but between her family and the intended paternity fraud victim. The victim was so incensed because the mother's family knew the truth and had often been questioned prior but had repeatedly lied to the victim.

Family court is a fraud and a government racket designed to fleece designated victims and the taxpayers. Paternity fraud needs to be treated like the crime that it is.

Family law is a different animal because the well-being of a young child is involved. Also, laws vary from state to state. I would recommend this guy find a good family law attorney. The mother may not be interested in pursuing child support which would be the best scenario. But the dangling birth certificate, if his name is on it, is a huge problem, not just now but far into the future.

Paternity tests should be automatic and required for all babies before they leave the hospital. JMHO.

This is the kind of rationalization that disturbs me. Accepting that we live in a society where marriage is considered passé by many. One guy thinks he's in an exclusive relationship with a girl, or practices safe sex. She meets another guy who is playing around, not using protection, and possibly spreading venereal disease. So rather than hold the romeo to account and pay for his child, a judge declares he is protecting the interest of the child rather than doing justice. I still don't understand how demanding one man to pay for another man's child is in the best interest of anyone. Assuming the sucker is better off financially, he is unlikely to love the child if he is being forced to pay child support. The argument you are making is that a judge should choose the wealthiest of a woman's paramours to pay child support rather than the biological father. That's not justice.

I agree with you and i am not attempting to argue anything, this guy needs legal representation now. IF, and we don’t know, he is indicated as father of this child on a birth certificate, which is a legal document, it has to be resolved. I could go into great detail, but believe me, regardless of a paternity test, at this point he is legally the father and until resolved will be until the end of time. A court could rule he is “legally” the father through his intent at time of birth. I know of one case, where there was no paternity test, the father was not on the birth certificate but lived with the mother and child before and after the birth of the child. The mother was killed in a car accident and the “father” wanted full custody of the toddler. There was a $100,000.00 insurance policy plus social security, he was a criminal scumbag. In the best interest of the child, the judge ruled he was the “legal” surviving parent regardless of paternity.

The laws on child support are there to protect the child’s best interest. They are not there to protect the adults or provide fairness.

It is what it is.

It is not the complete article. You double posted a couple of paragraphs, and left out the later paragraphs where we learn that he finally got the paternity test and is not the father.
