Law professors urge Biden to defy 'mistaken' rulings by 'MAGA' Supreme Court justices

resident Biden should find ways to defy the rulings of "MAGA justices" for their "gravely mistaken" constitutional interpretations, law professors urged in a letter on Wednesday.

Harvard law professor Mark Tushnet and San Francisco State University political scientist Aaron Belkin penned "An Open Letter to the Biden Administration on Popular Constitutionalism" to respond to what Biden has called "not a normal court" following high-profile cases.

"We urge resident Biden to restrain MAGA justices immediately by announcing that if and when they issue rulings that are based on gravely mistaken interpretations of the Constitution that undermine our most fundamental commitments, the Administration will be guided by its own constitutional interpretations," they wrote.

The letter continued, "We have worked diligently over the past five years to advocate Supreme Court expansion as a necessary strategy for restoring democracy. Although we continue to support expansion, the threat that MAGA justices pose is so extreme that reforms that do not require Congressional approval are needed at this time, and advocates and experts should encourage President Biden to take immediate action to limit the damage."

Tushnet and Belkin cited a solution known as "popular constitutionalism" claiming "that courts do not exercise exclusive authority over constitutional meaning." They theorized that Biden could explain how the Supreme Court’s decisions are "egregiously wrong" and offer an alternative constitutional interpretation, particular if the ruling poses a "grave threat."

"In this particular historical moment, MAGA justices pose a grave threat to our most fundamental commitments because they rule consistently to undermine democracy and to curtail fundamental rights, and because many of their rulings are based on misleading and untrue claims," they warned.

George Washington University law professor and legal expert Jonathan Turley penned an op-ed for The Hill on Saturday that warned about this interpretation of the constitution.

George Wallace, Ross Barnett, and other Southern governors attempted to defy Supreme Court rulings. Presidents Kennedy and Eisenhower met their defiance with regular US Army soldiers and nationalizing the State National Guards. However, if President Biden decided to defy the Supreme Court as Andrew Jackson did regarding the Indian Trail of Tears, he can do so with the only restraint being impeachment. He will not be removed from office with the current composition of the United States Senate.

Just incredibly wrong in every way. "Popular Constitutionalism?" WTF is that? The Constitution handbook on my desk mentions no such thing. If any of these so-called scholars from Harvard ever read that document or all the correspondence between the FFs, or their published statements, or their diaries, or their debates, they would find they have been wrong all along.

"Restoring Democracy". WTF again? They now have some who will fight for our Constitutional Republic and not democracy MOB rule which killed Greece and Rome where self-rule began.

Harvard Law School has become an indoctrination center for Socialists and Communists It was once highly regarded as an education institution. No more...what a shame.

You get a license to practice law from the bar.
The bar is a private organization.
It answers to no one or to no government entity.

Belkin served for 24 years as founding director of the Palm Center, which the Advocate named as one of the most effective LGBTQ rights organizations in the nation. He designed and implemented much of the public education campaign that eroded popular support for military anti-gay discrimination, and Harvard Law Professor Janet Halley said of Belkin that, “Probably no single person deserves more credit for the repeal of ‘don’t ask, don’t tell.’” When the military lifted its transgender ban in 2016, a senior Pentagon official said during a White House Ceremony that the Palm Center was one of the organizations most responsible for helping the Pentagon formulate inclusive policy for transgender troops.

"What is most striking about these professors is how they continue to claim they are defenders of democracy, yet seek to use unilateral executive authority to defy the courts and, in cases like the tuition forgiveness and affirmative action, the majority of the public. They remain the privileged elite of academia, declaring their values as transcending both constitutional and democratic processes," Turley wrote.

Turley is a good guy, a really good guy. A libertarian / liberal and still very constitutionally sound.

While I doubt I’d be saying a eulogy for these bastards if their lives are ‘abbreviated’, I’d be perfectly happy to see them fired and disbarred. They can learn to code at that point, for all I care.

Not good enough. Those that advocate for complete overthrow of the Constitution deserve much more exacting treatment.

Tushnet and Belkin obviously don't understand how the US system of government works - if their respective universities had any academic integrity at all, they would both be fired. They obviously are not capable of teaching their students anything real.

I believe these professors could make the case that Biden’s defiance of the Supreme Court would be in keeping with the actions of President Lincoln.

Just the mention of Lincoln’s name would attract liberals and others who have been deprived of history education for the past 60 years.
