New PayPal rule: The company can take $2,500 from your account for sharing misinformation (UPDATE)

Alittle less than a week before the midterm elections in November, a new PayPal account update will take effect that has sent the internet into an uproar — and also drawn condemnation from PayPal’s former president David Marcus.

What’s happening: PayPal is updating its acceptable use policy, with the update taking effect on November 3. You might say to yourself, well, I don’t use my account with the financial services company for anything improper or illegal, so what do I have to worry about? Here’s why that might not necessarily be true:

PayPal says it’s expanding its existing list of prohibited activities to include the “sending, posting, or publication of messages, content, or materials that meet certain criteria.” The full details are explained right here, but PayPal is basically set to start levying a fine when users are found to have shared “misinformation” or promoted content that’s deemed to be “discriminatory” or promoting “hate.”

PayPal account update The list of prohibited activities is broader than that, but it’s especially the prohibition on sharing “misinformation” that’s giving many people pause. Moreover, PayPal gives itself the right to debit $2,500 from your PayPal account for each violation of this new, expanded acceptable use policy.

Marcus, for his part, described this new policy as “insanity.” A tweet from him on Saturday, October 8, reads in part: “A private company now gets to decide to take your money if you say something they disagree with.” Venture capitalist David Sacks chimed in, in response to Marcus: “Get your money out of PayPal right now.” Elon Musk, an erstwhile member of the OG “PayPal Mafia,” also added his approval to Marcus’ tweet, writing simply: “Agreed.”

A bit of clarification is needed. PayPal is a payment processor. I don’t know of any way to post “Misleading information” ON PayPal. PayPal is not for posting opinions. It’s a money-transfer company.

So this means that PayPal has a way of determining if you have posted “Misleading information”. Do they get that information from Facebook/Youtube/twitter/instagram/tiktok/etc? Or is there one big database of bad people who have posted “Misleading information”?

Doesn’t matter if PayPal is now saying that this policy update was posted by a mistake. They nevertheless have the technology to determine who’s naughty and who’s nice, and to destroy the lives of people who they select for destruction.

Closed my personal account yesterday. Unfortunately, I have to keep the business account because too many customers like to use PayPal. But that account is not used to buy anything.

The same way I had a cell phone conversation with my Sister regarding picking up some quilts and comforters she no longer needed. The next day my phone was hit with dozens of ads for quilts and blankets.

Every transmission vocal or data is monitored, collected, and sold to the highest bidder.

What you say on your phone is listened to. What you post online is recorded for all of time.

However, PayPal is not fining people for misinformation is only one item, and does not cover "activities that.... are harmful ... or objectionable … (e) depict, promote, or incite hatred or discrimination of protected groups or of individuals or groups based on protected characteristics." And as the MSM article states:

And of this time Sunday 2pm, October 9, that language above is nevertheless still included in PayPal’s Acceptable Use Policy and its user agreement (here) states.
Which states,

If you’ve violated our Acceptable Use Policy, then you’re also responsible for damages to PayPal caused by your violation of this policy..You acknowledge and agree that $2,500.00 U.S. dollars per violation of the Acceptable Use Policy is presently a reasonable minimum estimate of PayPal’s actual damages - including, but not limited to, internal administrative costs incurred by PayPal to monitor and track violations, damage to PayPal’s brand and reputation, and penalties imposed upon PayPal by its business partners resulting from a user’s violation - considering all currently existing circumstances, including the relationship of the sum to the range of harm to PayPal that reasonably could be anticipated because, due to the nature of the violations of the Acceptable Use Policy, actual damages would be impractical or extremely difficult to calculate. PayPal may deduct such damages directly from any existing balance in any PayPal account you control.
And the Acceptable Use Policy states,

    Prohibited Activities You may not use the PayPal service for activities that:...relate to transactions involving... (f) the promotion of hate, violence, racial or other forms of intolerance that is discriminatory
    Now "the promotion of hate, violence, racial or other forms of intolerance that is discriminatory" can translate into what was ambiguously described as activities that:....." “Involve the sending, posting, or publication of any messages, content, or materials that, in PayPal’s sole discretion, (a) are harmful ... or objectionable … (e) depict, promote, or incite hatred or discrimination of protected groups or of individuals or groups based on protected characteristics (e.g. ... religion, gender or gender identity, sexual orientation, etc.) … or

    Right you are. This was a trial balloon that got shot down. ...OR maybe it was lots more seriously intended... n got shot down nonetheless.

    Entrepeneurs that use Paypal trend to be libertarian right and libertarian left. They don’t want to see this slipped in fine of $2500 for who knows what.

    If it was never intended to be inserted why did they insert it?

    How about this scenario in front of an honest judge where the accused is on trial for rape. "Your honor it is true I raped her by legal definition of law, but I did not intend to insert her so it was just a casual accident thus I am not guilty." He would not fare well in court.

    I have never liked PayPal, as it was difficult to correct transactions and customer service is poor to nonexistent. Nothing to do with politics, but there are better means of funds transfer than PayPal.
