I think they should, straight away. The judgment in one case should be consistent with the other. Justice would require either that NY cannot sue TX, or that TX can sue FedGov. Which will it be? Odds are that it would be neither; that is to say, no justice at all, with sanctimonious excuses that no one truly believes.

I thought I read here somewhere that Texas has already filed a lawsuit against the federal government

Since there really is no law anymore, the direct action taken by the two governors is the appropriate way to begin
