Lawsuit claims Carvana failed to register cars in timely manner

Car-buyers say they received temporary tags that ultimately expired

ABERDEEN, Md. — A Harford County man bought a car online from Carvana, but the sweet deal turned sour when he couldn't get the car registered in Maryland.

A tow truck repossessed Jo Riedel's SUV. He expected it to happen after he told the car dealer, "I'm not going to make any more payments on this vehicle."

Riedel, of Aberdeen, said he couldn't legally drive his 2017 Mitsubishi Outlander because it was never properly registered.

"It's been a full year of just needless headache and feeling of being ripped off and extra stress on our family that we don't need," Riedel said.

He bought the car from Carvana, the company with the giant car vending machines. The company's ads attract customers looking for an innovative online way to purchase vehicles.

"The buying process seemed a lot more streamlined. So, I was actually optimistic at that point," Riedel said.

But when the car arrived, he noticed something odd.

"I did notice that the temporary tags from the dealership said 'Carvana,' but they were from Georgia, which I found a bit interesting because I live in Maryland," Riedel said.

When the 30-day tag expired, Riedel said Carvana sent him another 30-day tag, which also expired.

"When I started complaining about not getting the tags after 90 days, they said that there was something wrong with the initial paperwork," Riedel said.

He said he sent new paperwork but still never got a title, registration or permanent license plates.

Evidently this is happening in several states. A Class Action suit was filed in Pennsylvania. And Carvana has settled two administrative complaints brought by the Florida Department of Highway Safety and Motor Vehicles in 2021 for a total of $14,000 over alleged delays of over a month in transferring titles to consumers. Also, Carvana entered a settlement over similar issues that temporarily suspended it from operating a dealership in Raleigh, North Carolina, for six months.

The state of Illinois confirmed it recently suspended Carvana's dealership license for misuse of issuing out-of-state temporary registration permits and failing to transfer titles.

My wife and I bought a car from Carvana in 2019, and it also had Georgia temporary tags, even though we live in Michigan.

Georgia is where Carvana’s headquarters is located, so that is the state they legally “sell” from.

However, we had no title or permanent registration problems.

but what is he supposed to do? Keep making payments on a car that can’t be registered? Let them repossess it, and then sue carvana for contract failure - plus any damages caused by the damage to his credit.

IMO, carvana is about to collapse into bankruptcy, like so many dotcom era companies of the late 90’s

You may be right. Their stock's gone down from almost $300 a share a year ago to about $35 now.

and I fully expect they will keep selling cars right up until the day they close their doors, leaving customers with cars that can’t be registered, deposits in limbo and warranties backed by nothing as well as a host of other problems - wouldn’t buy a car from them with a ten foot pole at this point until there is clarity on their viability as an ongoing business.

Hey, if it’s good enough for Sleepy Joe...

If his problems began in early 2020, it wouldn't surprise me that COVID was to blame. Most government offices were shut down as employees were sent home during the "two weeks to flatten the curve."

If the dealer sells the car at auction for less than the original loan amount Jo is on the hook to make up the difference.

Here’s the other problem. Caravan and Carmax allow you to put your vin on their website and they’ll make an instant offer.

I just sold a pickup last night (and happen to also live in Aberdeen, MD)

I got tons of “cash” offers for magically almost exactly what Carvana offered.

Part of my reply was the “cash” was immaterial to me. Whether it’s cash from your pocket, or cash from a loan, as the recipient,!I don’t care.

In any state that I’m aware of, you have to provide title within a certain time period.

Carvana leans toward being a subprime lending company.

All dealers doing secondary lending through banks, CU’s etc have to either provide title, or a letter guaranteeing title within a certain time period to get funded. My guess is they are using their own captive financing arm.

A friend sold a car via Carvana, except when they came and handed over the check, they didn’t take the car (removal is/was stated on the website as ‘we hand over the check and take the car away). They left it in his driveway. Calls to the 800 number were noncommittal on when the car would be picked up.

So he wrote to the CEO via email and said, “pursuant to standard local car storage rates, I’m now charging you $275/day to allow you to park this car on my property.”

A manager Ubered over and picked up the car that day— no invoice for the storage.
