Alec Baldwin Claims ‘Rust’ Contract Shields Him from Financial Liability in Halyna Hutchins Shooting Death

Lawyers for actor Alec Baldwin filed an arbitration demand on Friday arguing that his Rust film contract protects him from financial responsibility for the shooting that led to Halyna Hutchins’ death on the New Mexico set of the film last year.

The documents also make the claim that it was Hutchins herself who directed Baldwin where to aim the gun he held with which he fired the fatal shot.

Laying partial blame for the shooting on Hutchins, the filing says, “She directed Baldwin to hold the gun higher, to a point where it was directed toward her. She was looking carefully at the monitor and then at Baldwin, and then back again, as she gave these instructions.”

Baldwin’s filing adds that by giving the instructions she gave on the set, it was clear that Hutchins also felt the gun was unloaded — or “cold.”

“In giving and following these instructions, Hutchins and Baldwin shared a core, vital belief: that the gun was ‘cold’ and contained no live rounds,” the filing says.

Baldwin’s filing added that Hutchins agreed when Baldwin asked if should pull back the hammer of the firearm, as the script called for.

Baldwin has repeatedly claimed he never pulled the trigger of the single action revolver, but now that his court filing seems to admit that he at least pulled back the hammer to the firing position, that claim seems less believable.

The filing also alleges that it was not the actor’s responsibility to check the firearm he was handed to see how it was loaded, or if it was loaded at all, and that his title as executive producer actually shields him from liability.

A core, vital belief is not fact. I have a core vital belief that if I cross a busy street in the crosswalk, no one will hit me. I have a core vital belief that a bullet can’t ricochet off something and hit me. I have a core vital belief that the person holding the gun won’t hit the trigger or drop the gun. (Especially when he has locked back the hammer) Any of those can get you dead. So I have no core vital beliefs that he has I guess.

If my hands go on a weapon, second thing I do is I clear it meaning is it loaded, and in the case of a shotgun is there a shell chambered. The first thing I do is, before that, is it given to me safely. (I don’t take a weapon barrel first) Tack that on to never aim a gun at anything I am not planning to shoot...ever, and you’ve got a whole lot of core vital beliefs that the idiot didn’t believe in that he should have.

These are basic ways to keep people alive and any adult that handles weapons should know these. Appropriate for his mental capacity.

Another accident caused by someone who didn’t know and respect firearms. Perhaps just stupid actors should have their second amendment rights revoked.

Insurance does not pay out for stupidity/criminal negligence and a civil suite will not be your friend bub.
Effer needs to shut his pie hole but his ego will not let him. Where is his agent to keep him away from the poparazzi?
I not a fan of his, but Baldwin needs protection from himself.

Baldwin’s lawyer needs to get payed in advance with this defense. I assume Baldwin as the executive producer is in an LLC he may not get sued in that capacity, but physically participating as an actor and crew is a lot different.

I don’t think Baldwin intended to shoot this woman.

The person or persons responsible for props and safety on the set are to blame.

Other than firearms belonging to security personnel NO functioning firearms should have been within a mile of the set.

That said, Baldwin is a consummate ass.
