Judge Nichols has the analysis correct. It has been absurd the whole time to apply the obstruction of justice statute in the Jan 6 context. The section DOJ relies on was added to prevent shredding of documents. 🙄

Just in: Judge Carl Nichols becomes the first federal judge in DC to dismiss DOJ’s central obstruction charge in a Jan 6 case.
Ten other DC judges had upheld the charge.
Nichols’ decision comes in the case of Garrett Miller.
