A federal judge said on Monday that he will dismiss Sarah Palin’s libel case against The New York Times, concluding that Palin’s lawyers had failed to show the publication acted with actual malice.

Newspaper can slander someone, call them a murderer, and the newspaper gets away with it..of course they do, since Sarah is a Conservative she deserved it in their minds

Doesn’t the plaintiff have the choice of having a trial before a jury or before a judge?

I can’t imagine that anyone thought this would end any other way. First of all in NY, or in any of the other communist people’s republic city states around the US, for Sarah Palin, or any other conservative pol it would be nearly impossible to win a case like this. Maybe she can get somewhere on appeal but I doubt it.

Is there a difference between “actual malice“ and “malice.” Since we no longer have equal justice under the law in the United States of America, perhaps there is.

Judge setting a standard future democrats can be smacked with. Tread carefully, suicide tends to be multiple gunshots with them.
In the Kyle Rittenhouse case, the judge withheld his decision on a directed verdict until the jury came back. If the jury doesn’t convict, the judge doesn’t have to stick his neck out.

But whereas it is very hard to appeal a jury verdict, it is easy to appeal a judge's decision.
So at the end of the day, the judge is off the hook. He did what he could to swing it to the Times and if he is over-ruled well that is on the COA.
What is interesting is that he did not dismiss it earlier.
