I agree with the concept of some form of civil liability (with limitations), but Congress really has no business getting involved in it. With rare exceptions, civil tort cases are covered under state laws, not Federal law.

Causation is indeed tough to prove. And in the case of the vaccines there is also no causation proven. In fact statistical analysis demonstrates that all reported complications are in proportion to the general population. In other words there is no spike with the 100M vaccines. So the vast majority of the reports are coincidental not caused by the vaccination

As for caps. Noneconomic recovery should be capped As this is the windfall that most plaintiff lawyers prey on. As for fatality the inside joke in legal circles is it’s cheaper to kill someone then to maim them. Disgusting. Yes. But then so are most plaintiff attorneys.

You have no idea what the long-term effects of these “vaccines” might be.

I’m not opposed to caps in civil lawsuits. I simply use the example to point out that you can’t sit there on one hand and call for a “free market” system with no government intervention, while at the same time calling for caps on jury awards that must be written into law by government.

There is no graduated system to treating disease that I make more or less money. You obviously have idea how clinical services are reimbursed.

Any compulsory vaccination would have to be predicated on 3 major factors.
1. The disease is widespread.
2. The disease has a high morbidity and mortality
3. The vaccine has been proven to be safe and effective.

I don’t think anyone could conceivably argue that points 2 and 3 are true.
Even so, exemptions should be allowed for medical and religious reasons.
