Haven't our constitutional rights been dismantled enough already by pandemic paranoia?

Apparently not, as there are still many people more than willing to surrender (or simply too stupid to recognize that they are surrendering) their rights and freedom in the name of “safety” based on lies.

" think what they really desire is a right wing terrorist attack. They want McVeigh v2.0 I can just imagine what happens after that..."

Yes, and they want one bad enough that they could stage it themselves with appropriate cutouts so it can't be traced back to them.

> The vote on the AUMF for Iraq was a declaration of war in all but name. <

Right. But as I’m sure you will agree, the Constitution requires a declaration of war. It just does. If something is not called a declaration of war, then it’s not a declaration of war. It could be a resolution, or a law, or some other weaselly thing.

This is just another case of Congress ceding its power to the president. “We don’t want to stick our necks out by declaring war. It’s too risky. So we’ll just sit back and let you decide, Mr. President.”

This action will only get trumped in SCOTUS or Florida, along with Texas, will be seriously looking at getting out of the ‘union.’

Can Biden restrict travel to Florida?

Of course he can.

If the government can close churches, and businesses, and prohibit family members from gathering together, it's pretty naïve to think that it cannot restrict travel. The Soviets did this. First they made me wear a mask ... Soon will come the nighttime knocks on doors; to protect The People, dontcha know?

PROTECTION UBER ALLES.

“Can Biden restrict travel to Florida?”

I know how he could do it...National Guard block all roads at the borders of the Northeast states.😎

I don’t think it needs to be as dramatic as that. Any kind of resistance will be classed as an “insurrection” giving Biden the chance for military intervention. (I use “Biden” loosely, since he doesn’t even know what day of the week it is, but is the mouthpiece and signing hand of whatever actually is running our national government now.)

If Biden is stupid enough to impose a stable ban, DeSantis should retaliate and prohibit the export of all produce from Florida. No food for you.

Commerce clause. Welfare clause. National emergency. He can do it.

Plus Florida and many states already have (or did have) travel bans imposed on other states.

I think he has a good chance of succeeding should he try. He could start on anything federally regulated. Then threat funding. Then offer welfare payments.

Before he takes pen to paper, the president should have a look at the U.S. Constitution.”

Uh, this is a guy who has dismissed the Constitution in attaining power. The stupid is great here.

While you’re right about Iraq and Afghanistan, it’s unfair to single out W. We haven’t declared war on anyone since 1941. I believe we fought a couple of major wars between the end of WWII and the invasion of Afghanistan, so it isn’t just Bush.

Unlike Truman and LBJ, Bush at least, as required by the War Powers Act, got approval from Congress for his wars. I know we now are critical of these wars, but some realpolitik foreign policy thinking may be in order. There is a fairly major regionally hegemonic power in the Middle East. That power is governed by a theocratic radical Islamist government. That power has sponsored terrorist attacks against the US and it’s allies. That power has aspired to build nuclear weapons for some time. That power is, of course, Iran.

When Bush was POTUS, and more importantly, when there were large numbers of US troops deployed in Iraq and Afghanistan, Irannwas relatively quiet and well-behaved. After removing those troops, Obama felt it necessary to send a pallet full of cash and allow Iran to resume development of nuclear technology as an appeasement strategy. I’m not saying this was necessarily Bush’s intent, but take a look at a globe some time. Having large numbers of enemy troops surrounding a rogue country can certainly make that country behave a bit better.

Biden can write up any executive order that he wants to.

The only thing that can stop him are the courts.

Personally, I think it would be terrible PR for Biden to start a war with Florida. I think we could make a lot of hay out of that.

“(what, the 60th occasion since oath of office”

When I first read this I thought it said “Oaf of office”. Much more appropriate.

Yes, you’re right. As you noted, since 1941 America has been involved in quite a few undeclared wars. (I mentioned W because I have such contempt for him for his huge Iraq blunder.)

Anyway, someone once said that “A democracy should go to war reluctantly, and fiercely.”

Since 1945 we’ve been doing the opposite. Since then, America has been going to war almost casually. And those wars have then been fought half-heartedly.

YUP!

As to can he? no. constitutionally he can’t.
Will he? likely yes, and then it’s up to the courts to stop him. I have no faith in the courts.
