Can Durham, as special prosecutor, call upon military intelligence to help with his investigations?
When presenting evidence in indictments, can be also use data collected by military intelligence?
Was military intelligence used by any previous special prosecutor?

I don’t know the answers to the questions.
I can’t answer them, only enjoin on common-sense speculation.
Durham can use any and all information that has been declassified by POTUS.
That is why I believe that Durham submitted an update/report to Barr prior to Barr’s departure.
This was then briefed to Trump prior to Barr resigning (and may have been the impetus for that if Barr might be a witness).
Keep in mind, SCOTUS does not entertain evidence or witnesses.
That happens in the lower “court”.
Other questions that are currently open:
1. Did that update necessitate Durham’s change of position?
2. Why hasn’t Biden rescinded the DECLAS orders?
