I have to disagree with both of you. The court decision was wrong on two counts. First of all, as Justice Thomas said, the Supreme Court is the only venue for resolving this type of dispute among states. Texas had standing here, because there was nowhere else for Texas to go. But the second issue, the more important one, was that Texas charged that the states did not follow the US Constitution, which specifies that Only the legislature may set rules for how an election is conducted. This harms all states, and voters, as a state’s assistant to the governor’s volleyball team captain could decide that only wimen under 4 ft 8 with green hair born on Tuesday would have their vote counted.

Violating the rules of election procedure harms the constitution, breaks the contract among the states, and harms all citizens of the republic.

This seems correct. But I am not a lawyer. I’ve read several different perspective, maybe my normal y bias chose the one with least problems?

If this is correct and if the scotus should have taken this up, then it is time to MARCH against this injustice.

We really should not take this anymore!

You make excellent points, JoeA.

But I still think it would have been a very dangerous precedent, and that SCOTUS (hopefully) can pick from one or more of the other election cases headed their way.

The Texas case, by drawing the support that it did from other states, SUCCEEDED in proving the point that there is a huge portion of the country who feel the Constitution has been violated.

I would also add that General Flynn is pointing at foreign interference as the key national security issue, rather than whether States followed their own laws correctly (as was the primary focus of the Texas case).
