I have to disagree with both of you. The court decision was wrong on two counts. First of all, as Justice Thomas said, the Supreme Court is the only venue for resolving this type of dispute among states. Texas had standing here, because there was nowhere else for Texas to go. But the second issue, the more important one, was that Texas charged that the states did not follow the US Constitution, which specifies that Only the legislature may set rules for how an election is conducted. This harms all states, and voters, as a state’s assistant to the governor’s volleyball team captain could decide that only wimen under 4 ft 8 with green hair born on Tuesday would have their vote counted.
Violating the rules of election procedure harms the constitution, breaks the contract among the states, and harms all citizens of the republic.
