Barrett received confirmation on Monday Oct. 26. According to the articles I read, she was sworn in Monday night. Various news articles reported her as “seated” on Oct. 27. The PA Ruling with respect to the expedition request was determined on Wed. Oct 28.
The article I read stated that she didn’t participate, because there was insufficient time to read the briefs. To me that’s a recusal.
You can call it whatever you want.
There was an earlier ruling before the expedited request, but that is not the one I was talking about.
ThankQ - I was getting confused - ABC confirmation still pending when the case was heard & it’s a potential rehearing in future days that brought on discussion of recusal by RATs
I apologize...I am sure I am missing something.

This is a 10/28/2020 ruling - specifically noted:
“The motion to expedite consideration of the petition for a writ of certiorari is denied. JUSTICE BARRETT took no part in the consideration or decision of this motion.
Is seated different than sworn-in ?
