Barrett didn’t recuse, she hadn’t been seated yet.
*************************************************************************************

Barrett received confirmation on Monday Oct. 26. According to the articles I read, she was sworn in Monday night. Various news articles reported her as “seated” on Oct. 27. The PA Ruling with respect to the expedition request was determined on Wed. Oct 28.

The article I read stated that she didn’t participate, because there was insufficient time to read the briefs. To me that’s a recusal.

You can call it whatever you want.

There was an earlier ruling before the expedited request, but that is not the one I was talking about.

It was a legit recusal and smart to do. And sets the derps up for a fall. They never separated the ballots in PA either. How can Alito be pleased with that?
