USC 52 S 20701
Here goes, folks: §20701. Retention and preservation of records and papers by officers of elections; deposit with custodian; penalty for violation
Every officer of election shall retain and preserve, for a period of twenty-two months from the date of any general, special, or primary election of which candidates for the office of President, Vice President, presidential elector, Member of the Senate, Member of the House of Representatives, or Resident Commissioner from the Commonwealth of Puerto Rico are voted for, all records and papers which come into his possession relating to any application, registration, payment of poll tax, or other act requisite to voting in such election, except that, when required by law, such records and papers may be delivered to another officer of election and except that, if a State or the Commonwealth of Puerto Rico designates a custodian to retain and preserve these records and papers at a specified place, then such records and papers may be deposited with such custodian, and the duty to retain and preserve any record or paper so deposited shall devolve upon such custodian. Any officer of election or custodian who willfully fails to comply with this section shall be fined not more than $1,000 or imprisoned not more than one year, or both.
( Pub. L. 86449, title III, §301, May 6, 1960, 74 Stat. 88 .)
I hope that the outer certification return ballot envelope is also required to be retained.
Explain your thinking.
So disposing of records is a crime.
It does NOT say the votes are valid.
Great find, if it’s enforced. If not, what are the repercussions?
They can be counted again!
No,k
Any officer of election or custodian who willfully fails to comply with this section shall be fined not more than $1,000 or imprisoned not more than one year, or both.
== = = =
Not nearly enough punishment.
They purposely mix the bad ballots in with the good ones as quick as possible. One separated from the envelope, you can’t tell good from bad.
Thanks.
Yeah, I dont think so.
The Law also says to never speed. I suppose you are going to tell us no one ever speeds, now.
Your reasoning skills dont work in Reality World.
Well Trump is President for another 70 days or so.
If he wants, he could order a federal recount in ALL the states!
Consider for a moment that the results as they stand dont reflect the will of the people. If the legislature doesnt move this election closer to that will some will be looking for new employment in a couple of years...
A recount just recounts the ballots — the good and the bad that got mixed in — and confirms the fraudulent count. You need an audit.
They aren’t even enforcing the rule that votes have to be in by whatever time on election day anymore- they are shredding all the rules- bastardizing the election process- or attempting to anyways-
I live overseas so the franking part of the ballot doesn't work for me. I have to put the entire ballot as it would have been mailed in the USA inside of a regular envelope then pay the postage from Spain to get it to my local election commission in Georgia. When they receive it they make an electronic note of it that I can look up online. For example, my ballot for this latest election was received on 17 October. But if there was a challenge somewhere down the line I wonder if they save the original envelope I sent it in for proof or if they end up with an official ballot that has no postmark?

**********************************************
Yes, a FORENSIC AUDIT aimed at ferreting out fraudulent actions.
In our state it is, because it contains the signature. Each ballot must have a corresponding name/signature whose name appears on the role of registered voters. . (One person: One vote SCOTUS Gore-Bush). Any without is null and void.
Three of the SCOTUS justices represented Bush in 2000 fiasco. They are well versed in election law.
If they have, say 1,000 ballots, and only 500 signed envelopes, isn't that a contaminated vote? Or did they shred the envelopes?
