he liberal justices dissented as the Supreme Court ruled against extending Wisconsins deadline to count mailed-in ballots received after Election Day.
Supreme Court Justice Elena Kagan slammed the courts decision not to extend the deadline to receive mail-in ballots in Wisconsin and said it would disenfranchise voters in a pandemic.
In a Monday ruling, the Supreme Court sided with Republicans in its decision to block Wisconsin from counting mail-in ballots that are received after Election Day, Nov. 3.
The Courts decision will disenfranchise large numbers of responsible voters in the midst of hazardous pandemic conditions, Kagan wrote in her dissent, joined by liberal justices Stephen Breyer and Sonia Sotomayor.
The justices were split 5-3, with the conservative majority negating a lower courts ruling that had ordered mailed ballots to be counted if postmarked before Nov. 3 and received up to six days after Election Day, as they had been during the states primary.
In her dissent, Kagan noted that the COVID19 pandemic has turned in-person voting (with its often-long lines, touch screens, and enclosed booths) into a health risk. (snip)
As the COVID pandemic rages, the Court has failed to adequately protect the Nations voters, Kagan wrote.

And she actually sits on cases that might involve questions of scientific fact.
It’s not their job.
I don’t suppose any other states with delays past November 3 will be hearing from the SCOTUS before then? Like NC, for example. Six days after 11/3, ballots can be counted.
The only "Safe" thing to do is burn all the mail in ballots as soon as they are received.
"It is for the children"
My wife has diabetes and Stage 4 cancer. She is not even a little bit afraid to go vote.
Our son went through a stem cell transplant last year. we learned a lot about masks and such. We know these little paper things don’t do any good.
>>Get your a** to a drop box. Theres one in every Town.<<
They tried putting them in SF and other blue cities but they got stolen, burned up, or filled with feces.
Wrong one. THIS one is the former obama official who was IN CHARGE of shepherding the ACA into existence. Even as kagan had a hand in creating obamacare, she has NEVER recused from any case against it.
The Leftists in Congress nearly always vote in lockstep, too.
The Hive shuns diversity.
Ill be voting in-person. Same as the last ~50 years.
It aint hard.
The Wisconsin legislature can change this anytime they want.
However, no court can.
F* that, b****! Protect the Constitution!
How hard is it to vote? Really?
But we live in a solidly Republican county where things are on the up and up.
joe and the ho would have a hands down winner platform if they had just promised to hermetically seal and bubblewrap everyone and nothing bad will ever happen to anyone, ever.
The one thing liberals hate above all is LOSING! After POTUS is reelected I would look for both Kagan and the wise Latina to leave the court for health reasons. They will not have the fortitude to withstand losing without a moral compass to hold on to.
WWG1WGA!
Stephen Breyer is 83. Will be make to 87 or is President Trump going to replace another politician/fake judge ?
Elena Kagan was the fruit of a family of communists. Her brother teaches/taught at an elite high school in NYC and was excited for the NYT to come observe in his classroom when Elena was going through her interviews for SCOTUS. The Obama Admin put the kibosh on that idea very quickly.
Her lack of recusal in regards to OBAMACARE showed her lack of character and honesty. Neither she nor Sotomayor should judge even a pie eating contest.
I will bet these people have had their ballots for at LEAST 3 weeks why in the hell would they need extra time to mail a ballot!!
We had paper ballots in NC. They gave you a pen and said keep it.
NC has curbside voting for this.
At least in Cabarrus
Now she should recuse herself from all such future cases.
