The Supreme Court nominee would be the third(!) sitting justice, alongside Brett Kavanaugh and John Roberts, who worked on the Republican side of Bush v. Gore.

Watching the Senate Judiciary Committee get bumfuzzled by the cutting-edge technology of the public-address system on Wednesday was certainly a highlight of the hearings into the confirmation of Judge Amy Coney Barrett. All of a sudden, a little before two in the afternoon, just as Senator Richard Blumenthal was beginning his turn, the committee room’s audio system failed. By my own observation, the committee members responded to this awkward happenstance by standing around like a Middlesex County road crew.
Anyway, as the delay rolled on, I was musing about the nominee’s bizarre insistence that she could express no opinion on anything at all regarding our national elections. On Tuesday, she refused to say definitively that the president*any presidentcannot unilaterally delay an national election. Neither would she say definitively that she feels that the president* should commit to leave office peaceably if he loses in November. And, in a by-play on Wednesday with Senator Amy Klobuchar, she declined to commit to the defense of absentee ballots, but not before having a glitch in her memory every bit as spectacular as the audio glitch that later silenced the committee entirely.
KLOBUCHAR: I want to turn to something we talked about yesterday... You worked on the recount in Florida that was related to the Bush v. Gore case, including on an absentee ballot issue on behalf of the Republican side of that case, is that right?
BARRETT: I did work on Bush v. Gore on behalf of the Republican side. To be fully honest, I can’t remember exactly what piece of the case it was.
That was the greatest and bloodiest politico-legal brawl since the 1800 presidential election. Working on the Republican side of it was a terrific career move for ambitious conservative lawyers. (How terrific? Two of Barrett’s prospective bench mates on the Supreme CourtChief Justice John Roberts and Justice Brett Kavanaughwere both members of the Bush legal team.) Are we seriously to believe that Barrett doesn’t remember what work she did during that historical moment? Apparently, Klobuchar knows what it was. And then we moved on to the relevance of that work to our current moment.
KLOBUCHAR: We are in the middle of a global pandemic that is forcing voters to choose between their health and their vote. Are absentee ballots, better known as mail-in ballots, an essential way for voters to vote right now?
BARRETT: That is a matter of policy on which I can’t express a view.
This prompted Klobuchar to end this Battle of the Amys by bursting out with a little Minnesota nice scoffing.
KLOBUCHAR: To me, that just feels like a fundamental part of democracy, but OK.
For all the emphasis on the future of the Affordable Care Act and the future of Roe v. Wade in these hearings, the nominee has been the most dangerously mushy on election law and voting rights. We all accept as fact that the president* will bring the republic down on his own head if it will keep him from being voted out of office and, therefore, vulnerable to a staggering number of criminal indictments. And, even though it laughably defined itself as non-precedential, Bush v. Gore established as fact the Supreme Court’s ability to meddle in presidential elections and, indeed, to decide them de facto. When she is confirmed, this nominee will join two other justices who worked with her on the legal strategy that ended up as the illegitimate meddling in Bush v. Gore. She will be on the Court when and if the decisions relating to this election arrive there.
I don’t believe that Barrett doesn’t remember what she did in 2000. I think she’s proud of it. I think what she told Klobuchar is a barefaced non-fact.
