If I understand it correctly, the ruling was narrow enough that no actual land ownership is involved. It just means that the crime on the res has to prosecuted by the Fed not state courts.

The basis was that Congress had not made any law regarding the restriction of the reservation-for those particular areas. All congress has to do is pass a law similar to those it has passed for the other places in Oklahoma.

As far as Mount Rushmore, the land was taken away from the Indians by Congressional Act. However, the records to prove payment could not be found. So the Indians were awarded money in 1980 by Supreme Court as just payment + interest.

The Indians then said that the lawyer had no right to do that and rejected the payment as they wanted the Land not money. So the money is sitting and drawing interest waiting on the Indians to give up and accept it.

It’s limited even further in that it’s only crimes committed by Indians on the Res are to be prosecuted by the Feds. All others (US citizens and visitors) State law still applies.

Actually if what is contained in another post on this thread is true that Nickola Tesla tried to give free energy to the nation, but was stopped by the DS, then the technology might be there.

Other than that we would be on the road back to the 17th century, but even without coal.
