I am a veteran criminal law attorney who has tried more than 300 criminal jury trials, handled thousands of other criminal cases, racially-divisive cases, etc. We have dozens of "citizen lawyers" on Free Republic who are posting insane, inane, wrong, and crazy "facts," "law," and conclusions. I have studied this case inside and out. Let me give you some insight, and feel free to post some questions....
The two are police officers from a largish city. They are not rednecks.
This may or may not be race related. There isn’t enough information to make any statement on that.
What is clear is that a man was killed by two armed men.
It SEEMS clear (we need to wait for more information), but this seems clearly an unlawful death and the two who killed him MUST be prosecuted.
In this case, there is overwhelming PC that Arbery was committing a crime within the knowledge of McMichael.
The dad told the cops that he was “in his yard” when he observed Arbery “hauling ass”, and he told 911 that he saw the suspect with his own eyes.
The McMichaels live 50 yards away or less. The home under construction had been burgled several times; Arbery was recognized as the prior burglar by McMichael,who had seen Arbery on his street and on video; it was a Sunday when construction workers wouldn’t be on site; Arbery SPRINTED from the property.
When McMichael shouted “stop” while in his yard, Arbery kept running. Any judge would find a strong presumption that a stranger who bolts out the door of a previously burgled home was up to no good. At a minimum, he was trespassing, but there was almost certainly PC to believe he was stealing stuff (or attempting to steal).
Not black. Racist hispanic yutes hurling ugly epithets. Not treated as a hate crime or attempted murder by the police.

What world do you live in where it’s OK for someone not in law enforcement to shoot someone where there is no evidence of a personal injury crime?
Someone breaking into your home? Threatening you or your family? No one is going to complain about that.
There are so many other ways this could have been handled. But these to morons were excited about catching a black guy in their redneck neighborhood. With nothing in his hands. And going away from the area.
So yes...these guys deserve some time in Prison.
Which begs another question. Where was Obama’s son working? Was he employed?

So you’re giving these men due process and reserving judgement for when more facts come out and/ or trial?
Or have you convicted them in the court of public opinion?
I live outside of Houston in the next county up. The inner city thugs come up here regularly to do their criminaling.
They like to branch out to the middle and upper class areas because they’ve destroyed their own and/ or there’s too much competition.
Simple as that. The thought that ANY of them would come up here simply to jog in a random neighborhood not their own is LUDICROUS.
The race hustlers are going to have to start moving their narrative from the jogging thing because they don’t even believe that. They are going to have to start focusing on if the guys had probable cause to attempt to try to hold him for police (even though they never got that far achmed the felon attacked them.
.It was kind of weird because the current DA was saying he was going to let a grand jury decide whether or not to charge them.
Which told me he didn’t think he had enough to build a case.

"Abolishing prejudice and racism" is the top priority for the Democrats.
Creating a safe and prosperous environment for people to work and live is my priority. Part of that priority is to not make it easy for burglars, of whatever color, to operate with impunity.
Yep but they expect him to sit around while thugs ravage through properties all around where his family lives and just call 911 for some 2nd year post academy street cop to try to figure out who it was and catch them.
My brother in law is a former cop and I cant imagine him knowing my neighborhood was the victim of several property crimes recently, watching a guy flee from my neighbor house that had been the recent target of thugs, and him just watch then run down the street getting away and sayin “ok we did what we could, let’s let him go while the cops go on a wild goose chase after him after he’s long gone so he can come back tomorrow when all the men are work and only the women and children will be here.
THAT’S LAUGHABLE.
OF COURSE he and my husband would chase them down until police got here. Now a one time thing where wasn’t a recent history of it and we hadn’t seen the guy prowling around before? Nah they may not pursue that. But in exact same circumstances? ABSOLUTELY!

There was enough evidence for probable cause which was all the men needed to pursue or detain him.
That’s the bottom line.
According to the police report, they saw the same guy, a few nights earlier. They thought he was potentially armed, that is why they grabbed their guns. They failed to call the cops about that situation.
And.... if you are going to try to stop a thug or even engage one, it’s a good idea to ALWAYS be armed.
