No, he's not.

The judge in the case, the liberal activist Judge Amy Berman Jackson, did something very weird, which was to sentence Stone while he still had several motions sitting before the court.

My speculation is that she wanted to "symbolically" sentence him, so that her pals on CNN can say "Roger Stone, who was sentenced to 40 months in prison, before having his sentence overturned". The LibTards are huge on this sort of game playing. "Impeached forever".

Liberal Activist Judge Amy Berman Jackson has heard the arguments that a mistrial should be declared because the Jury Forewoman was a Democratic activist and Trump hater who was stupidly Tweeting about Roger Stone's guilt before the trial began. This was so egregious that even the Liberal Activist Judge did have to make a show of having a hearing on it, which included bringing the LibTarded Jury Forewoman to swear that even though she was tweeting how horrible and guilty Stone was it did not mean she did not judge him fairly.

Yeah, right. Sure thing, honey.

Anyway, Liberal Activist Judge Amy Berman Jackson is in a real bind. If she does what she wants to in her poison black heart and rules that there is no cause for a mistrial, she has given Team Stone a great, wonderful case for appeal. Because this is a high visibility case she will forever carry the reputation as having ridiculously tried to railroad Stone, before being overturned on appeal.

Her chances of making it through a Senate confirmation hearing for a higher level of Judgeship in the future goes to Zero if she carries the tag "the judge who tried to railroad Stone". Not being overturned (particularly on high visibility cases) is a factor in being promoted to the Appeals Court.

But, she might do it anyway.

If she throws it out, then William Barr has to decide if the DOJ is going to waste more time on prosecuting Stone for lying to Adam Schiff, which even if true, seems unworthy of his and our attention at this point.
