I think the Judge has to approve his withdrawal of the plea. There has to be a basis recognized by law to withdraw a plea, because he has already pleaded and agreed under oath that he was guilty. Given the Judge’s ruling on the discovery request, I am not sure that Sullivan will let him withdraw the plea, but it will give him another issue on appeal if he doesn’t. The only thing that might give the judge an out is that if the plea is withdrawn, then the discovery that was previously requested might be required to be provided after all.

Given what’s happening in the FISA court, and with Stone’s case, and how Sullivan reacted to the last motion, I am not optimistic, but Flynn will win on appeal, of that there is no doubt. Hopefully he can have bail while the appeal is pending, but Sullivan has been a jerk lately, so who knows.

This is a travesty.
