Prosecutors arent pursuing a criminal case against the dad who said he forgot he left his 1-year-old twins in a scorching car, where he found them dead after returning from work, according to a report.
Juan Rodriguez appeared in a Bronx courthouse, but the district attorney elected not to put the case before a grand jury at this time, according to WABC.
His next court date is Aug, 27.
Rodriguez was charged Saturday with two counts of manslaughter and two counts of criminally negligent homicide for the Friday deaths of tots Phoenix and Luna.

It’s not murder . we’ll disagree on this of course.
Sometimes a cigar is just a cigar. But apparently some people want, need or demand that it be something more. Yes, this response was meant for you and while it may seem a non sequitur, it is not.
It’s actually possible to do that.......otherwise these wouldn’t be happening.
I am not arguing that he shouldn’t have been sentenced, tried and given jail. My only point is regardless of all that, IF the man really has a conscience, he will live haunted by what happened all his life.
It’s depraved indifference and/or manslaughter.

He says this can happen to anyone and points to a survey of parents of young children where 25 percent admitted that at some point they forgot their child was in the car.
Again, so what?
if they find proof that he was into hanky- panky that day, will they be able to try him?
So what? Two chldren are dead. Adults expect competence from other adults charged with the responsibiity for infants and children. If he had run over two complete stranger children with his car by accident, he would have been charged with manslaugher.
Yep, I hope they keep a close eye on him and see what he does.
Reminds me of the Darlene Routier case here in Texas from a ways back, so was seen smiling and spraying “Silly String” over the graves of the kids she murdered (AFAIK she’s still on Death Row).
They won't if they don't bother to investigate, that much is certain. What is certain is that he acted negligently regardless of intent, and two children are dead. To think their lives don't deserve justice is to think the law deems children the "property" of their parents. If they were someone else's children he was transporting, he would face charges.
Consumer reports also have articles on ‘How and why” these happenings 0ccur... as do plenty of others who have investigated and researched why this happens who also agree with that article......

Call it negligent homicide or whatever you want, the result is the same, they are dead.

So what? Are you saying you have postive proof that he wasn’t drugging, drinking, hung over, or coming off a bitter fight with his wife or in-laws? If what you claim is so overwhelming that the law shouldn’t matter, everyone would be doing it. But everyone isn’t. But many people are slipping into a self-involved universe of emotions, self-indulgence, constant texting and denial of responsibility; and you are not helping.

A co-worker decided he was living in a rut. So he decided to alter the sequence of his getting-ready-for-work regimen. He did and only realized he had not shaved until he got to work.
It’s hazardous to alter muscle memory and habit. Habit can take over too easily.

I'd say he didn't forget they were in the car, but that he forgot that he did not drop them off.
