'Gun free zone' law disarmed Virginia Beach shooting victim, attorney says

The night before Kate Nixon and 11 others were murdered by a disgruntled co-worker, the decade-long Virginia Beach city employee talked with her husband about bringing a gun to work for self-defense -- a decision that was taken out of her hands by the city's ban on employees carrying firearms at work, a Nixon family lawyer said.

Now, Nixon's family is calling for an independent investigation into events leading up to the May 31 shooting and what could have been done differently before and during it, particularly given the explicit concerns about shooter DeWayne Craddock.

“Kate expressed to her husband concerns about this individual in particular, as well as one other person,” Nixon family attorney Kevin Martingayle told WHRV's "HearSay with Cathy Lewis" radio show Monday. “In fact, they had a discussion the night before about whether or not she should take a pistol and hide it in her handbag -- and decided not to, ultimately, because there's a policy apparently against having any kind of weapons that are concealed in the building."

The city of Virginia Beach prohibits employees from carrying "any weapon" while working or on city property, unless authorized by a supervisor. The city policy notes: "The prohibition against possession of a weapon applies even if a member has a permit to carry a concealed weapon." . . .

Clearly they need bigger signs that say GUN FREE ZONE to deter maniacal and demented mass shooters.

Sue the city.
They left the employ unprotected and failed to provide protection.
They violated the employee’s constitutional rights.

Rewrite the law to specify that it also applies to criminals and anyone with criminal intent. And that shooting people on the beach from locations off the beach is also prohibited. Because obviously they didn’t get the message.

To protect itself, the city should have all employees sign that as a condition of working there, they will not protect themselves, and they will hold the city harmless when they are killed or injured as a result.

Interesting that she felt threatened by the shooter, prior to the day of the massacre. I had not heard, before now, that anyone was concerned about him.

She was most concerned about another worker who was supposed to be fired that day. He was the victim with the most wounds.

I worked for awhile at a gun-free place. And a few of my coworkers had handguns hidden near them. That was a firing offense, for sure.

But yeah, I felt safer because of it.

A truly effective sign would read “Employees and other persons on these premises are authorized to be armed with concealed handguns”.

If you put up a “gun free zone” sign and do not actually make everyone who enters pass through TSA style x-ray machines and body searches then at best you are lying and at worst you are creating an attractive environment for anyone who wants to commit a gun crime without fear of victims shooting back.

IMHO, any business or governmental entity that puts up a “gun free zone” sign should be strictly liable for any damages incurred by any victims of gun crimes on the premises.

The odd thing was I was in Virginia the week or so before the incident and I noticed a number of the places I visited (museums and other locales) had these “no guns” signs to greet visitors. You wonder who they are trying to fool in these sorts of instances?

If we had allowed guns at work, I’m quite sure I would have witness a couple shootings during my work career. People can really be asses.

Yep. And having a concealed permit explicitly states that you shall abide by all applicable Federal, State, and Local laws and ordinances with regard to carrying concealed.

What about the unpermitted and unconcealed weapons every person carries around all the time?

F that. I work in the medical field and there are frequently patients on the premises who are drunk, stoned, or otherwise not right in the head. There is no security provided by the company so I take responsibility for my own and that of my co-workers.

Yep. And by abiding by that you can feel real proud of yourself when some maniac murders you or your loved one.

You do things your way and I’ll do things my way.
