If your intent was to spy and communicate covertly, why would the first thing you do is apply to the Federal Gov’t for a ham radio license that would alert the FCC and anyone with Google Search that you’d done so?
It’s a stupid coincidence. You can buy radio equipment and use it without a license and the odds of getting caught are about the same as winning the lottery. Which is what any true spy would do.

I disagree - the FCC fines and shuts down broadcasters all the time for overpower, non-license, etc

It’s very easy to locate the broadcast point of a signal, even if you relocate periodically, which is why emissions control in the military is so important. Plus if they broadcast without a license encrypted that is an instant red flag.
I drew up the plan to sneak up on a bunch of fellow destroyer squadron ships paired with the Japanese using strick emcon. My ship was paired with Philipine forces - who were very worried about the strict emcon. We ‘salvoed’ and ‘took out’ the lot before they knew what hit em because we knew where they were and they had no clue where we were. Then we launched helos to take out the scraps.
I wanted to preposition the helos ahead and to the north with no emissions and then draw enemy fire that way, but the CO and aircrew overruled me since it was just a training exercise. I did get a pat on the back from the ol’man and overheard him telling one of the senior officers he wouldn’t want to go up against me planning wise. One of my proudest moments .... all due to emcon.
