Recusal for conflict of interest is a matter of lawyer ethics, not a regulation.
It is up to the judge to remove the defense attorney. IE, draws out the proceedings.
The EO, effective Jan 1, 2019, allows for Civilian counsel of those subject to tribunal (LOAC).
