Since it was fictional, they should ask him to sign an affidavit punishable by perjury charges.
When he comes clean and confess that he was not on the phone (because it didnt happen) then put the screws to this hate crime HOAXER for filing a false report and blaming Trump supporters.
How many thousands of “hate crime” hoaxes have the media headlined over the last 30 years?
Just a few weeks ago they were running with a story of white guys killing an 8yo black kid, turns out it was black drug dealers. That was followed by the Covington Kids hoax. Remember how MSNBC deliberately altered Zimmerman’s 911 call, and how they would lightening his complexion and always referred to him as a “white Hispanic”? Remember the “hands up don’t shoot” hoax?
Watch, in another week the media will be at it again, promoting another hoax. They never apologize, they just move on to the next hoax.

CWB Chicago is reporting that it received a tip a week ago that Smollett’s friends bought the rope at Ace Hardware and took a Lyft to the scene of the crime.
And the cops have had his actual phone records all along, just wanted to see what he would try to hide.

Comments say that they found/followed these actors from Lyft/taxi logs. They apparently went to an Ace Hardware.
