Vanity: SF Arts Commission Threatens Artist for Not Using Gender Neutral Prefix "Mx."

Making the email rounds:

For years, my brother and I have addressed women with the prefix Ms. to be respectful of the fact that they don't want their marital status known to the public.

When he sent an email to the female staff member who oversees the Street Artists Program he received the following email:

My brother was shocked and confused because he was being respectful to her and he had never heard of the use of Mx. as a prefix before so he sent her the following email:

Anne Trickey,

I understand that you may prefer to be referred to as Mx. rather than Ms. However, like you, I have my preferences.

I prefer that the Arts Commission go by the Brown Act, Municipal and State law before the Arts Commission implements any new Street Artist Program policy that has the effect of amending or amends the ballot measure Proposition L. the Street Artist Ordinance.

I also prefer that the Arts Commission obey the will of the SF voters and implement the ballot measure, Proposition L. the Street Artist Ordinance the way it was intended by the voters of San Francisco.

I would also prefer an apology from the Arts Commission since I was correct about the Community Working Group being a policy body and not a passive meeting body. The Arts Commission was so certain I was wrong and they were correct that they treated me with scorn and disdain for filing a Sunshine complaint to stop the Arts Commission from violating the law.

Finally,I also prefer that in the future you don't lay your non-street artist personal politics at my doorstep.

About a week later when Bill found out that the SFAC Executive Committee was going to vote on next year's Street Artists Program's budget and Trickey failed to notify him about the meeting then Bill sent the following email to Trickey:

In March, Bill received the following email from Barbara Mumby who is another SF Arts Commission staff member:

Although Anne Trickey respectfully informed you of Anne’s gender neutral preference of ‘Mx.’ when addressing Anne through email, your responses to this preference are considered to be of an antagonistic and harassing nature. Someone’s gender identity, regardless of one’s personal feelings, is a protected class under law, both at the federal and local levels. An excerpt of the Mayor’s policy, which we reference at each public meeting for the Street Artist program is as follows:

City policies, along with federal, state and local laws, prohibit discrimination against or harassment of City employees based on race, sex and the other categories listed below. Discriminatory or harassing comments about or in the presence of City employees, even comments by third parties, may create a hostile work environment, if severe or pervasive.

City policy prohibits discrimination or harassment of its employees on the basis of: Race, color, ancestry, national origin, ethnicity, place of birth, sex, age, religion, creed, disability or medical condition, HIV/AIDS status, sexual orientation, marital or domestic partner status, gender identity, parental status, pregnancy, weight or height or any other characteristic protected by state or federal employment discrimination laws or by the San Francisco Charter or local ordinance.

For your reference, these polices are drawn from: · Cal. Govt. Code §§ 54954.3(a), (c), 54956(a)

· Admin. Code §§ 67.15(a), (b) ,67.16

As you can see, the issue of gender preference is not one of ‘personal politics’ but of federal and state law.

We respectfully request that In the future you use Anne’s preference of ‘Mx.” or simply by name, “Anne Trickey” when addressing Anne. The ongoing failure to do so will be considered to be harassment and could adversely affect your participation in the Street Artist Licensing Program.

Recently, I became aware of another male street artist who also innocently used the prefix Ms. in an email he sent to Trickey and he received the same threatening response from the SF Arts Commission if he referred to Trickey as Ms. again instead of Mx.

My brother feels like he is the one being harassed by the SF Arts Commission when he did nothing wrong.

All he did was attempt to redress some of his grievances about the way the SF Arts Commission is managing the SF Street Artists Program.
