perceived attempt to harm. IE if someone swings at you but misses that is still an assault. The victim perceives the intent. It is the prosecution that must prove however that there was the perception of harm due to the attempt.

Intent is not required for assault though that would come into play in an attempted assault which frankly is a rare charge since the victim would not perceive it but someone else would. What most people hear of when they think of attempted assault is actually attempted battery which is an actual assault...swing and a miss.
