They probably took the daughter to a nice kid's movie like Perter Rabbit. After the movie, off to the restaurant.

1) This is California; it’s a two-hour commute from work so we eat late.
2) By 9pm the early birds and the local crowd have thinned. The waiters are more attentive because it’s their last chance for a big tip.
3) Since a 9pm seating is usually the last or next to last seating, no one hurries you to eat and vacate the table for the next customer so your dinner is much more enjoyable.
4) If the 5yo gets antsy, it disturbs less customers, and so is more considerate

I was grocery shopping with my five-year-old daughter last night at 11:00 pm. She enjoys it. We can chase her to bed but she doesn’t actually sleep till a bit after midnight.

Are you serious? Maybe that is when the three of them could go! Is there a rule somewhere that a child cannot be eating dinner at that time of the evening? sheesh

Wow that's what yo got out of this? How special you must be to want to impose your parenting views. You appear to be a member of the It Takes a Village Idiot Club.

Maybe you could try and focus on the fact that some sick son of a bitch almost killed this man while his five year old, who will carry the trauma the rest of her life, but no let's address the really horrible aspect of the story, that a couple took their five year old to dinner at a restaurant at HORRORS 9:20 pm!
