Tribune-Herald staff writer Tommy Witherspoon is live-tweeting from inside the courtroom in the trial of Jacob Carrizal, the first biker to be prosecuted for his alleged role in the May 17, 2015, Twin Peaks shootout.
Jury selection is underway, and opening statements are expected to be given this afternoon.
Nine people were killed and dozens injured in the melee between rival biker groups the Bandidos and Cossacks.
The judge and attorneys are talking to prospective jurors individually now. These are the ones who asked not to speak publicly about issues.
The judge is talking to the parties in chambers. They might begin calling in potential jurors who didn't want to talk about issues in public
Her last question: "Will each of you promise to give Jake Carrizal the fair trial he deserves and has been waiting so long to get?"
Gotro is asking each of the 145 or so on the panel if they will follow the law.
Gotro said a jury is allowed to disregard evidence if it finds the evidence was illegally obtained.
Gotro is asking the panel about items searched and seized without probable cause.
The gun discussion is ongoing. Gotro has really got the panel talking now, with comments on all sides of the issue.
Many say there are too many guns but they aren't comfortable with the government seizing guns from lawful owners.
Now she's got the panel in a 2nd Amendment discussion, asking if there are too many guns and if they fear the government will take them.
Gotro is saying that "technicalities" that people often chide defense attorneys for exploiting are actually important constitutional rights.
Gotro asked why someone would lie to a police officer.
Gotro is talking about the unreliability of eyewitness testimony and reasons why it can be flawed. One juror said Twin Peaks served alcohol.
Gotro is warning jurors against what she called confirmation bias, having formed an opinion and only listening to evidence that supports it.
She is asking if witnesses, including police officers, always tell the truth. One juror said it is unlikely a police officer would lie
Gotro is picking up her voir dire where she left off Tuesday evening. She is asking why defendants might not take the stand.
The parties have agreed to proceed without the missing juror, but the judge ordered deputies to continue looking for him to execute the writ
The judge told the panel that we can't proceed at this time and recessed the proceedings actually before they started.
The judge issued a writ of attachment for a no-show juror and the judge is recessing the panel until he is located.
Stay tuned. There is never a dull moment around here and you never know what is going to happen next. But you can bet it won't be ordinary.
The jury panel is coming in now and defense attorney Casie Gotro will continue her voir dire examination of the panel.
Its only a promo for the movie "12 Angry Men"
Thanks for the update, interesting info for sure
That's a possibility. Another that comes to mind is that Reyna (and Co.) could now become as wounded animal -- and in that way even more dangerous to defendants whom cannot afford a Clint Broden, a Susan Christ, or a Paul Looney and a few other capable legal advisor/representatives I'm not naming.
That's what would worry me if I were among the many defendants still under indictment.
The drama is for from being over. Stay tuned this channel.
and now, time for us to take a commercial break -- A word from Our Sponsors
Full movie follows the promo
Thanks for the up-dates
Well, well, not quite a win but not a loss either. More like an expensive exercise in futility.
I guess the big question now is will the County try again or move on. I’d love to be a fly on the wall where they are having the meeting to decide that very thing just to see how their thought process worked.
Hmm. Wondering where the smartest know-it-alls on these threads who told us this was a slam dunk walking away are?

Perhaps he was down being considered for jury selection. If so, Im sure he said that he has an open mind on this and will render his jury vote considering only the trial evidence.
lol.... Some Freepers are people I would like to meet IRL. TG not so much.
I’m sure they’ll be along shortly to tell us that the jury was made up of “drug dealing/users” that are “anti-cop” and biker gang members that are just sticking up for the same. /sarc
ESAD!
Make that some here believe anyone who owns a motorcycle is filthy scum.
The charging instrument is very specific.
Specific enough that attempt to stretch what was created by State legislature aimed at organized crime as enhancements provisions, without sufficiently firming up the underlying identified conditionals inherent to stated provisions was too far of a reach in what was supposed to be a slam-dunk (they told Paul Looney "...flat out... they were looking for a slam dunk").
Chapter 71 was so "specific" and easy-peasy simple-as-pie-even a caveman could have read out loud a 57-page jury charge (in about on hour or so of repetitive rambling) that had been written-up to help show the jurors how simple everything about this truly was.
Unless we should include Judge Matt Johnson with myself and others around here in signing up for and undergoing psychological counseling sessions held in facilities with one of those "anger management classes held here" banners over the front entrance of a businesses like that, located in a strip-mall development next-door to the 'Traffic School' that serves up pizza and comedy acts (we make you laugh!) as part of the draw, so that we could all of us come to better understanding ---what went wrong?
If not for our own selves, do it for the children and others around ourselves, for "better understanding". At least it seems to me I heard that sort of thing around here a whole bunch of times.
It must be true, it was said so much. <---{as true as my name is joe isuzu kind of true, that last} I'm so honest I tell you when I'm lying
Thank you for all the work you’re doing.
Thank goodness he’s a Floridian.
Thank goodness hes a Floridian.

Is that a species of lizard?
I’d rather hang out with bikers than anyone who professes to be a demonRAT!!! Totally disgusted with the bootlickers on FR lately!
Yep. I was told I was too stupid to reply to because “I don’t know anything about the law”. By a really, really smart guy, so, you know, put me in my place and all. This was just a matter of going through the motions, foregone conclusion, because, you know, biker scum and so damn smart and all.
I hear ya
