Tribune-Herald staff writer Tommy Witherspoon is live-tweeting from inside the courtroom in the trial of Jacob Carrizal, the first biker to be prosecuted for his alleged role in the May 17, 2015, Twin Peaks shootout.
Jury selection is underway, and opening statements are expected to be given this afternoon.
Nine people were killed and dozens injured in the melee between rival biker groups the Bandidos and Cossacks.
The judge and attorneys are talking to prospective jurors individually now. These are the ones who asked not to speak publicly about issues.
The judge is talking to the parties in chambers. They might begin calling in potential jurors who didn't want to talk about issues in public
Her last question: "Will each of you promise to give Jake Carrizal the fair trial he deserves and has been waiting so long to get?"
Gotro is asking each of the 145 or so on the panel if they will follow the law.
Gotro said a jury is allowed to disregard evidence if it finds the evidence was illegally obtained.
Gotro is asking the panel about items searched and seized without probable cause.
The gun discussion is ongoing. Gotro has really got the panel talking now, with comments on all sides of the issue.
Many say there are too many guns but they aren't comfortable with the government seizing guns from lawful owners.
Now she's got the panel in a 2nd Amendment discussion, asking if there are too many guns and if they fear the government will take them.
Gotro is saying that "technicalities" that people often chide defense attorneys for exploiting are actually important constitutional rights.
Gotro asked why someone would lie to a police officer.
Gotro is talking about the unreliability of eyewitness testimony and reasons why it can be flawed. One juror said Twin Peaks served alcohol.
Gotro is warning jurors against what she called confirmation bias, having formed an opinion and only listening to evidence that supports it.
She is asking if witnesses, including police officers, always tell the truth. One juror said it is unlikely a police officer would lie
Gotro is picking up her voir dire where she left off Tuesday evening. She is asking why defendants might not take the stand.
The parties have agreed to proceed without the missing juror, but the judge ordered deputies to continue looking for him to execute the writ
The judge told the panel that we can't proceed at this time and recessed the proceedings actually before they started.
The judge issued a writ of attachment for a no-show juror and the judge is recessing the panel until he is located.
Stay tuned. There is never a dull moment around here and you never know what is going to happen next. But you can bet it won't be ordinary.
The jury panel is coming in now and defense attorney Casie Gotro will continue her voir dire examination of the panel.
I don’t see how Jack Smith was much of a rebuttal witness.
Difference is the gangsters supporters here support the gangs.
“He said the Bandidos are an outlaw motorcycle club but not criminal. He said it is like outlaw country music.”
ROTFLMAO!
“Not buying the official story” is not the same thing as supporting gangs.
Which story do you buy into in?
1. Cops say they saved lives.
2. Bikers say cops saved lives.
The jury is beginning it deliberations now.
12:50 PM - 9 Nov 2017
Cops would have saved more lives (at least the 4 that they shot to be specific) if, instead of waiting in the shadows for something to happen, they were out in the open to PREVENT anything from happening.
The only contact they have had is to ask for more copies of the court's charge and to get their lunch. They have sent no other notes. 4:04 PM - 9 Nov 2017
They were out in the open. In fact, a Cossack told his buddies that no way would the bandidos pull anything with all the cops there.
“How about this option:”
How about quit defending the biker gangs!
The jury wants to see the dash cam video from Waco Police officer Michael Bucher's vehicle. 4:53 PM - 9 Nov 2017
The judge is making arrangements for the jury to watch the video in the jury room instead of returning to the courtroom to watch it. 4:54 PM - 9 Nov 2017
The jury watched the video and returned the laptop to the court after about 45 minutes. 6:08 PM - 9 Nov 2017
There has been no word from the jury but the court staff just arrived with Rudy's barbecue for the jury's dinner. We are still here. 7:37 PM - 9 Nov 2017
Thanks for the up-date,,,,,,,
Where have you seen the words that I’m defending the biker “gangs”? I’m not! I’m criticizing the cops for allowing the violence to start so they had an excuse to shoot at least 4 people!
“Where have you seen the words that Im defending the biker gangs? Im not! Im criticizing the cops for allowing the violence to start so they had an excuse to shoot at least 4 people!”
ROTFLMAO!
You again defend the biker gangs by laying fault on the cops when you should be laying fault on the biker gangs.
DUH!!!!!!!!!!!!
There is a note from the jury. The judge took the lawyers into his office, so we don’t know if it is a verdict or a question from the jury
9:24 PM - 9 Nov 2017
The note also said, "Mr. P indicated he has personal experience with the Cossacks and his opinion won't change." 9:38 PM - 9 Nov 2017
The note says some members are becoming extremely animated. 10:07 PM - 9 Nov 2017
The judge's response to the jury says they can continue to deliberate or be sequestered at an undisclosed hotel. 10:08 PM - 9 Nov 2017
Jury sees they need to sleep on it. They asked the judge if they can call family to tell them they are OK. 10:36 PM - 9 Nov 2017
They also ask if they can make arrangements for fresh clothes and medication. 10:37 PM - 9 Nov 2017
The jury, plus the two alternates, are back in the jury box. 10:38 PM - 9 Nov 2017
The judge said jury can make one phone call in the presence of the jury and only one phone call. Jurors appear very solemn. 10:39 PM - 9 Nov 2017
Thanks for all your effort.
So, in your mind, all cops can do no wrong and all bikers can do nothing right. You’re a total a$$!!!
