A California man sued the state and California Lottery Commission alleging he was wrongfully denied a $5 million Scratchers ticket prize because his 16-year-old son bought the winning ticket.
Ward Thomas filed a lawsuit with the Los Angeles Superior Court claiming the commission's failure to discharge a mandatory duty, breach of contract, negligence and both intentional and negligent representation. The suit seeks unspecified damages.

Exactly. Let the state cross-claim in the retail vendor that allegedly made an illegal sale, if it wants to recoup the amount paid out to the ticket bearer.

It depends on how it is applied. In Nevada, during fiscal year 2014, more than $2.0 billion in taxes and fees were paid by Nevada hotel-casino operators. This included major contributions to Nevada’s three largest sources of revenue: sales tax, property tax and gaming tax. Nevada hotel casinos account for nearly $1.4 billion, or approximately 45 percent of State General Fund revenues more than any other industry. These funds can be applied, and is, to security forces, infrastructure, trash reclaimation, schools of which they have four within the top 200 rated high schools in the nation using funds coming from the gambling to assist, .
So don’t think states shouldn’t be involved with the gambling. It is a simple way to increase needed funds for populous required services. And taking it from the front, cuts out the middle man for profits.

State gambling is at least a “voluntary tax”.
it’s odd to think that a state can’t fund trash pickup without resorting to gambling, and it’s even more odd to hold up nevada as some sort of paragon of well managed states — seeing as how it’s built on a house of cards (no pun intended) and all.
He will lose. The law is explicit about who can buy the tickets and the State of California will do anything to keep from paying this out.

If the California Lottery operations do not legally mandate that lottery ticket retailers ask for a valid Id for proof of age to the buyer, then I’d think the family with the winning $5 million ticket has a chance of succeeding in their suit - with the state negligent in making any effort, through their lottery ticket sellers, to require age-of-buyer rules be enforced.
The California Lottery commission should (a) get the bad P.R. off their back and pay the $5 million, and (b) establish rules making it the retailers problem for selling lottery tickets to under-age customers, and requiring them to ask for an ID from anyone they suspect is under age.
Probably happens a lot in California.

Most of the stores where I buy mine are pretty darned careful about checking ages. Losing just their lottery sales would be a revenue hit, although I don’t know what their commission rate is. They’d probably lose some sales on other items as well as having the possibility of being fined.

Man, hate to say, but no sympathy....16 year old kid bought the ticket illegally, so no dice.
Also don’t feel sorry for the retailer that sold it to him and will now be reamed.
How do they know who bought the ticket?

If that’s so, then that’s really stupid on the part of the 16 year old.
