A former Nebraska teacher has been sentenced to 90 days in jail for having sex with a student on his 16th birthday.
Emily Lofing, 27, was charged with debauching a minor as the boy was 16 years old, the age of consent in Nebraska. Lofing did not contest the charge, WOWT reports.
The married former teacher was working in Weeping Water at the time of the offence. She is alleged to have met up with the teenager to have sex in July 2016.
Her lawyer, Desirae Solomon, claimed she had suffered a mental breakdown and pleaded with the judge to consider Lofings stress from work and family history of depression as contributing factors to her behaviour.
Ms Solomon said Lofing had been leading a double life and people who have known her for her whole entire life were shocked at this type of behaviour, KWBE reports.

At 16 I would have taken a lap or two. Just the nature of hormone driven teenagers.
I find the sentence - even the fact of guilt - to be absurd. Not because of her looks, but because the age of consent in Nebraska is, apparently, 16. The judge said that she was less than 24 hours from a felony - which, if I understand either English or the law, means that she did NOT commit a felony. She/they PURPOSELY waited until he was old enough to be at the age of consent. That this was scummy of her to take advantage of a teenager is beyond doubt...but did she violate the letter of the law? I don’t think so.

Summer vacation. Nobody's going to be traumatized when they take the teacher away.

In most states, Age of Consent is 16, but there are exceptions... including those who have authority over the teen, most especially teachers, police, counselors, etc. I'm betting that's where she sent wrong.
He probably is. She’s only 27 so he is likely close to that.

But it still doesn't really explain the relevant Nebraska law.
The lenient sentence comes due to Nebraska state law allowing any 16 year old to consent to sex, even with a teacher. Nevertheless teachers because of their role as educators are strictly forbidden to fraternize with students, never mind sexually prey on them, except that is in the state of Nebraska.

No, the victim is still legally underage and therefore protected by law. That’s her husband, I’m guessing.
