ACLU preparing for legal challenges if Trump gets elected

The American Civil Liberties Union (ACLU) released a 28-page report Friday arguing most of the presumptive Republican presidential nominee Donald Trump’s governing agenda is unconstitutional, and promises to keep a running tally of all Trump’s policy goals that run afoul of the Constitution.

Titled “The Trump Memos,” the analysis encompasses the New York billionaire’s proposals on immigration, torture, libel, abortion, and government surveillance. It effectively serves as a blueprint for the legal arguments the ACLU would marshall when challenging Trump’s initiatives if elected president.

“Donald Trump’s proposed policies, if carried out, would trigger a constitutional crisis,” ACLU Executive Director Anthony D. Romero wrote Wednesday in the Washington Post. “By our reckoning, a Trump administration would violate the First, Fourth, Fifth and Eighth amendments if it tried to implement his most controversial plans.”

“But we need to be prepared because the very freedoms guaranteed by the Constitution could come under a sustained attack by a President Trump in the Oval Office,” he continued. “If that day comes, make no mistake: We’ll be seeing him in court.”

50 years ago when I was younger and dumber (but I would like to think no less idealistic and no less committed to the Constitution), I joined the ACLU believing that it was an organization operating on principle. 50 years of observation have disabused me of that notion.

In my defense I can say that the 1960s were a different time in which the Warren court, despite its overreaching in its abundant faults, was expanding the rights of individuals in ways that were arguably principled. Thorny issues like separation of church and state and the privacy rights of individuals were defensible on both sides. Now it is impossible to regard the ACLU as anything other than a rank pressure group which inhabits our jurisprudence with a consistently leftist goal and an unquenchable thirst to exploit the Constitution, no different in purpose or method than the Southern Poverty Law Center.

In reviewing these allegations laid out in this article, one sees no specifics, no precedents, no application of the Constitution to specific facts. What we will see is a guerrilla campaign tailored toward jurists like Ruth Bader Ginsburg to pop out preordained rulings.

Meanwhile, I will have to nurse my pesky but orphaned libertarian tendencies without the dubious help of the ACLU.

IIRC, the ACLU gets beaucoup bucks from Uncle Sam. Cutting that off would be a good start.

One of Trump's first Bills sent to congress should name the ACLU and Planned Parenthood as anti-American terrorist organizations to be immediately shuttered, with all their executives and employees being spayed/neutered to prevent our having to hunt down and exterminate their defective progeny.

Just a thought...

If they were honest in their respect for the Constitution, it would read "promises to keep a running tally of all Trump’s policy goals Obama's policies instituted by executive order that run afoul of the Constitution."
