I think that a pardon can only be against a court finding. If Hillary doesn’t get indicted and tried there will be no court finding of guilt and thus no possibility of a pardon. If Obama did try to pardon her, what would he issue it for? The treasonous exposure of state secrets? Using her office for personal gain via the Clinton Foundation? Pay for play schemes? The pardon itself would read like an indictment.

Having said that, we can only hope that she loses and the next president goes after her. Of course, it will probably backfire as it always has. The media is what makes the Clintons invulnerable.

A president has full use of his powers while under impeachment. Once convicted by the Senate, he would be immediately removed from office and thus stripped of his powers. Until that moment, though, the fact that the House had impeached him would not affect his ability to pardon whomever he wants.

The actual text of the Constitution is your friend.

Here is the relevant provision, Article II, Section 2, Clause 1:

The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States; he may require the opinion, in writing, of the principal officer in each of the executive departments, upon any subject relating to the duties of their respective offices, and he shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.

As I read this, the President has a plenary power of pardons and reprieves (i.e., commutation of sentences), but this does not apply to federal office holders who have been impeached (in other words, the President cannot stop an impeachment proceeding by “pardoning” the person who was impeached). This provision does not state that the President’s pardon power is suspended if and when he is impeached.
