Hardly. He goes after a Cop, cop fires 9 times and they take the perp. to the hospital?
I have no idea how many rounds found the target. Point is if you're advancing on a LEO with a weapon in your hand, threatening the LEO, he has every right to drop you. I would do the same.
If this is the scenario, it's a good shoot.

Or more gun. DPD standard is Sigs in 9mm firing Federal Hydra-shock. And I suspect the shootee was well dosed with recreational pharmaceuticals at the time.
