Attorneys for a refugee from Burma say Muskogee County sheriffs deputies wrongfully took money from the man meant for a church, a Christian band, and an orphanage in Thailand.
The man, who is a U.S. citizen living in Dallas, appeared in court in Muskogee Monday morning.
Hes now charged with acquiring proceeds from drug activity.
However, Eh Wah did not have any drugs in his possession when he was pulled over in Muskogee.
According to the deputys report, Wah was pulled over for a broken tail light and was not arrested. The deputy said his K-9 indicated an alert in the vehicle, and the deputy searched it.
No drugs or paraphernalia were found, only cash.
Court documents show Wah was managing a band from his home country of Burma.
Sheriffs deputies seized $32,000 in cash from a gift bag in Wahs car that he says was raised from concert ticket sales, offerings collected by churches, and donations from individuals meant for the Dr. T. Thanbyar Christian Institute, a nonprofit Karen Christian liberal arts education institute in Burma.
Wah also had more than $7,000 in proceeds from CD sales during the tour.
About $1,000 of the seized cash was in envelopes with the name of the orphanage in Thailand on them.
In total, court records show deputies seized a total of $53,249 in cash from Wah.
The claimants of the cash deny it was used to facilitate the sale of any controlled dangerous substance.
Wah does not have a criminal record. Hes now free on a $5,000 bond.
He is due back in court in July for the criminal charge.

If the lawyer gets a 50% contingency on getting the money back, that will net about $26,500 for the victim. Then a $20,000 retainer on the criminal charges and $5000 for the bond, and the victim should end up with about $1500. The lawyer probably will need to share some of his $46,000 with other interested parties, so it won’t all end up in his pockets.
If you can teach a horse to ‘do’ math, how hard can it be to get a dog to ‘alert’?
The guy should have told the deputy they he was on his way to pay #BlackLivesMatter protesters at an anti-Trump rally. They probably would have offered him a police escort.

Neither the cops’ story or the guy’s story smells legit. Who the heck carries around $53,000 in cash?

The second amendment solution kicks in?
This started under the first Bush.
Typically to get it back you have to.
1. Prove the source of the money. This is difficult with cash.
2. Prove it was acquired legally.
3. Prove the money is actually yours.
4. Prove you paid taxes on it.
5. Convince the Sheriff that you deserve the money more than they do. They do not have to give it back even if you are innocent.
Nebraska just passed a law saying they had to convict you before they could take any property.
That's why I say that everyone should keep an open bag of dog treats in their car. If nothing else, it's reasonable doubt that the dog "alerted" to the bacon!

Any cash found and confiscated by police is deemed and treated as drug money. ALL cash is open to legal confiscation by any law enforcement agency at any time in any meeting of a LEO and another person.

My hunch... just because it was a “bunch of cash” means it had drug contamination; drugs are so ubiquitous now. Why does this need to be argued over and over in courts to be SOP? (Yeah I know. Because it’s a racket.)
Burma (Myanmar) itself, however, isn’t all that Christian-friendly to date. Uncle Sam probably isn’t yet ratting to Myanmar, but a suspicion that he might, is a possible rationale for wanting to keep it secret. The context should be understood. It would probably be easier to convince a Trump (or even Cruz) administration of this than an Obama administration.

At the end of March, a Calgary Police dog attacked a 12 year old, chasing him into his home, pinning him on the kitchen floor and biting him. The boy’s father got the dog off by punching the dog twice in the stomach. Eventually, the handler, who lived in the neighbourhood and had let the dog off the leash, ran into the house and took the dog away. It was the first time neighbours had seen the dog off his leash.
If one of my dogs did that, the cops would have shot my dog or it would have been put down at the SPCA and I would face a BIG fine, if not criminal charges. The police dog was not euthanized. Charges against the handler? Of course not! Some animals are more equal than others, especially the two legged, ‘blue’ kind.

The criminal charge is going to go like this:
A probable cause hearing to show the right of the state to seize the cash because the state suspects it was from drug business
The probable cause is the dog alert
It could be that alone by itself is the crime
Carrying suspected drug cash
They sit on out hwys all over America looking to do just this
Or maybe the guy had separate charge elsewhere...the article doesn’t specify
They can seize your money even without charges btw
Back when we were free they could only take assets for unpaid tax or a judgement
Then it could be forfeited after conviction if relationship to the crime proven
Then it was seize whatever can be found once charged
Now it’s seize if found and suspicion meets probable cause judge views which are akin to grand jury and ham sammich
You can fight back though which is why they like to leave you dead ass broke so you’ll compromise guilty or not
