I’d keep the concept of hate crime, but narrow it down to people who commit crimes in order to foment or carry out religious or racial strife. Someone who simply wants to hit someone and yells a racial or anti-religious epithet at the same time is just an idiot, probably happy to be accused of a ‘hate crime’ so he can get the attention he never got from mommy.

Leave the notion of legislating on thoughts alone.
the criminalization of thought scares me....why do we have to consider the thought process behind the crime when punishing or make having a thought illegal...A murder is still a murder no mater why the person did it. vandalism is still vandalism. I think it is important that the police understand the thought process and the motivation but in the court room it has no place.
Thought legislation, of course not.
But intent has always been a factor in criminal law. If you are unaware of a risk to pedestrians and drive like a maniac, you can only be culpable for criminal negligence, while if you are aware of a risk to pedestrians and drive like a maniac, you are liable for crimnal recklessness, and if you either intend to run someone over, or act with depraved indifference, then you are liable for murder if you kill someone. Similarly, if you buy a halloween mask and wear it on haloween, it’s not a crime, but if you are caught on tape conspiring with a friend to rob a liquor store, and you then purchase haloween masks, you can be prosecuted for criminal conspiracy.
So, too, if you intend to start a race war, and towards that end you lynch a few memebers of the race you want to have a war with, that and only that should be a hate crime. Your actions have a larger intention, bordering on insurrection and treason.
Just shooting or assaulting a few people and shouting ‘up yours, (racial epithet of choice)!” is not a hate crime, just a crime.
