This week the 7th Circuit Court of Appeals ruled that people here in the US illegally are subject to 2nd Amendment Rights. For legal citizens, some states will not allow the sale of a firearm to someone who does not LEGALLY reside in that state thus impinging on a LEGAL CITIZEN's 2nd amendment rights. How is it that the 7th found that an illegal alien, regardless of which state they reside in can purchase a firearm when a legal citizen has to first LEGALLY RESIDE in the state?
PING
There is a simple solution, require ID for the background check that illegals can’t provide.
The OP makes the ruling potentially a good thing: the decision can be used as a precedent to make exactly that case, and possibly strike down the federal law that prohibits out-of-staters from buying arms in other states. Similarly, it can be used to strike down state laws (e.g. NJ, MD) which prohibit people from out-of-state from bringing “illegal” firearms into the state. After all, as the OP says, if an illegal alien can legally do it, a lawful citizen ought to also be able to legally do it.
Just when I thought my blood pressure was alright . .
That sort of argument can be used to then require background checks for all transfers, including within a family or for private sales. Which then eventually puts every gun on paper and into the federal database. Not good.
How is it that an illegal alien from Guatemala or Mexico can attend a university as a resident, but a citizen from another state cannot...?
You mean the ID that they can’t be compelled to show when they vote...?
Shall not be infringed.
Because natural rights exist absent the constitution.
Bottom Line: Liberalism/progressivism/Marxism/Maoism/Socialism/Communism - which are all shades of the same color, is standing on your head and telling the world that it’s upside down.
This ruling supports all other gun control laws passed by the states or the Feds prohibiting types of firearms, ammunition, full capacity magazines, etc.
This is not a good ruling, as it supports infringing on 2A rights up to and including complete prohibition.
You already have to do that anyways....
I will never understand why we give aliens (that includes those legally here also) the right to bear arms within our open nation.
American citizenship means your a$$ is taxed more to give to those unwilling to work for themselves or families and aliens have just as many rights (if not more) than we have
Court: Second Amendment also covers those in US illegally
But then the decision went further to extend the equal protection of 2nd Amendment right to the illegals. In direct contrast to other Federal laws (18 U.S.C. § 922(g)(5), which forbids illegal immigrants from possessing firearms in the United States.
The presiding judge ruled that even though the 2nd Amendment extended to the illegal alien, the Federal prohibition of possessing ammunition by an illegal alien was constitutional.
Had your summary been true, then the justice would have ruled 18 U.S.C. § 922(g)(5) unconstitutional, referencing Heller as precedent.
a few states are issuing driver licenses to illegals
bkmk
A complete Bizzaro world we are living in when those who should not be here enjoy our liberties.
