Ted Cruz was born in Calgary, CA on December 22nd, 1970. At the time of his birth, his mother was an American citizen.
Now picture a female American soldier stationed in, say, Germany. She gives birth to a boy. The boy was not born in CONUS, but there is no doubt he is an American citizen because his mother is a US citizen.
To me, Cruz's situation is equvilaent.
There is nothing in the Constutution, to my knowledge stating that Cruz would not be eligible to be POTUS based on the circumstances of his birth.
My kids were all born in German hospitals, off base. They were US citizens at birth.
“I sure wish the Founders had been more specific . . .”
I believe they relied on, and may have referenced a definition extant. As I recall, it depends on being born on territory of the United States, which can be offshore, and there are certain exceptions having to do with military stationed in non-US Territories. But it requires more than a U. S. citizen mother in the case of an offshore birth.
“Which is why Obama is not a U.S. Citizen by Birth. His Father was not an American Citizen and his Mother did not meet the five year requirement to transfer Citizenship to her Son, Barry Soetero.”
Which is why many believe that Barry had all his personal information locked up out of view of all that cared about what was going into our WH.
Think of it this way...do you need a positive law to keep and bear arms or is that a natural right?
You are lying.
See #8.
You obviously set great store by what you are told.
That is not the attribute of a proper American! Fail!
That makes you anti-military, since there are lots of military brats, some of whom might make great presidents (no, not Crash, but he's a military brat), who do not fulfill your definition of Natural Born.
It's really simple: if you are entitled to citizenship by reason of your birth, you are natural born, even if the birth took place on the other side of the moon. Don't get confused by 18th-century furriners from Switzerland.
Nope. You are a natural born citizen because of your parents, not because of where you were born.
Otherwise, if a Panamanian mama were to have dropped a kid on that US base where McCain was born, said kid would be a citizen and be eligible. But that's not the case. So, being born on a US base is irrelevant. It's the parentage.
And I will add that it was well known and read by the founders...
If you have to ask, then you are not Natural Born.
“Now picture a female American soldier stationed in, say, Germany. She gives birth to a boy. The boy was not born in CONUS, but there is no doubt he is an American citizen because his mother is a US citizen.”
Author did not state in his example or scenario whether or not subject was born on a U.S. military base. Overseas military bases, as embassies are considered to be US soil. My example is John McCain, born in a U.S. military hospital in the Panama Canal Zone, thereby eligible to run for POTUS.
Are you in the market for a very nice bridge, by any chance?
In spite of all that Barry Steven Sortoro’s place of birth and when he was born is still in question.
He’s a spider baby being born else, crept here, brought here somewhere abroad in some 3rd world crap hole, most likely in Kenya or Indonesia and brought here and all his papers were forged.
From the U.S. code: "The following shall be nationals and citizens of the United States at birth: (a) a person born in the United States, and subject to the jurisdiction thereof;"
So then by your definition we're all citizens by statute and nobody is a natural-born citizen.
They were also familiar with William Blackstone:
"The first and most obvious division of the people is into aliens and natural-born subjects. Natural-born subjects are such as are born within the dominions of the crown of England, that is, within the ligeance, or as it is generally called, the allegiance of the king; and aliens, such as are born out of it. Allegiance is the tie, or ligamen, which binds the subject to the king, in return for that protection which the king affords the subject. The thing itself, or substantial part of it, is founded in reason and the nature of government; the name and the form are derived to us from our Gothic ancestors...The children of aliens, born here in England, are, generally speaking, natural-born subjects, and entitled to all the privileges of such. In which the constitution of France differs from ours; for there, by their jus albinatus, if a child be born of foreign parents, it is an alien."
bttt
That is true. However, there is something in the Constitution that causes Ted Cruz to be ineligible to seek the office of president.
There is nothing in the Constitution that says the people cannot elect Ted Cruz but there is something in the Constitution that says Ted Cruz cant run for president.
Does that sound confusing?
Ted Cruz is over 35 years of age but is not natural born. Natural born does not refer to Ted Cruzs birth. Natural born refers to his parents birth, both parents. The founders added these words in the Constitution applicable onlyto the president but not applicable to Congress.
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;
Making the effort to understand the issues the founders were trying to avoid by adding that restriction to presidential candidates but not to congressional candidates will relieve some of the confusion.
